(1) A superior
court’s power under this Act to make an order in a case may be exercised
by the court on its own initiative or on the application of any party
unless —
(a) this
Part provides that the power may be exercised on the application of a
particular party or person; or
(b) the
contrary intention otherwise appears.
(2) An entitlement
under this Part to apply for an order includes an entitlement to apply for an
order that amends or cancels the order, unless the contrary intention appears.
(3) A power under this
Part to make an order includes a power to amend or cancel the order, unless
the order finally concluded the case or the contrary intention appears.
