CRIMINAL PROCEDURE ACT 2004 (NO. 71 OF 2004) - SECT 73
73 . Court
may set aside decision on its own initiative
Whether or not an
application is made under section 71, a court on its own initiative may
make an order that sets aside a decision it has made in a party’s
absence on a charge and that orders that the charge be dealt with again, if it
is satisfied that it is in the interests of justice to do so.
