(1) In preparing an
emergency plan for a mine, the mine operator must consult the
following —
(a) an
emergency service organisation that may need to respond to an emergency at the
mine;
(b) mine
emergency workers of any mine who may be required to participate in
implementing the emergency plan;
(c) in
relation to the principal mining hazards that may cause or contribute to an
incident that may adversely affect the health and safety of persons in the
area surrounding the mine —
(i)
any local government in whose district the mine is
located; and
(ii)
any regional local government established under the
Local Government Act 1995 section 3.61 in whose region the mine is
located.
(2) The mine operator
must ensure that the emergency plan addresses any recommendation made by an
organisation consulted under subregulation (1)(a) in relation
to —
(a) the
testing of the emergency plan, including the way in which it will be tested,
the frequency of testing and whether or not the organisation will participate
in the testing; and
(b) what
incidents or events at the mine should be notified to the organisation.
(3) The mine operator
must have regard to any other recommendation or advice given by a person
consulted under subregulation (1).
