(1) The mine operator
of a relevant mine must ensure that a mining operation does not commence at
the mine unless —
(a) the
mine operator submits a radiation management plan for the mining operation at
the mine to the regulator; and
(b) the
regulator approves the plan under subregulation (2).
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
(2) The regulator may
approve, in writing, a radiation management plan for a mining operation at a
mine if the plan —
(a)
includes —
(i)
a plan for monitoring workers’ radiation exposure
under clause 2.7.2(b) of RPS‑9; and
(ii)
a plan for discharges of radioactive waste, including
authorised limits for the discharge of the waste; and
(iii)
the incidents about which the mine operator must notify
the regulator;
and
(b)
otherwise complies with clause 2.7.2 of RPS‑9.
Note for this subregulation:
Not approving a plan
under this subregulation is a reviewable decision (see regulation 676).
(3) The mine operator
of a mine the subject of an approved radiation management plan must ensure
that the plan is complied with.
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
(4) An approved
radiation management plan for a mine is part of the mine safety management
system for the mine.
