(1) A builder is to ensure that he or she acts only within the area of his or her expertise and experience.(2) A builder who performs building work is to ensure that (a) a relevant permit, authorisation or notification is issued in respect of the work before it is commenced; and(b) the work is performed in accordance with the relevant permit or authorisation and this Act; and(c) the quality of the materials used in the work is in accordance with the relevant permit or authorisation and this Act; and(d) the work is performed on land owned by the owner; and(e) the work is performed in a manner that does not cause (i) a public health risk; or(ii) a danger to the public; or(iii) a nuisance to an adjoining owner; or(iv) damage to infrastructure; and(f) any directions under this Act in respect of the building work are complied with; and(g) sufficient information is supplied to the owner for the owner to maintain the building in accordance with this Act.(3) A builder intending to perform building work under this Act must hold the relevant licence under this or any other Act, if required, to perform that work.Penalty: Fine not exceeding 250 penalty units.
