CORPORATIONS REGULATIONS (AMENDMENT) 1998 No. 185 - REG 58

58.1 Omit the Part, substitute:

"PART 9.4-PENALTY NOTICE OFFENCES AND PENALTIES Prescribed offences
(Corporations Law, s 1313)

"9.4.01. For paragraph (b) of the definition of prescribed offence in
subsection 1313 (8) of the Corporations Law, an offence against section 144,
subsection 601CW (2), (9) or (10) or section 428, 457 or 541 of  the Law is a
prescribed offence. Prescribed penalties (Corporations Law, s 1313)

"9.4.02. (1) For subparagraph (a) (i) of the definition of prescribed penalty
in subsection 1313 (8) of the Corporations Law, the prescribed amount is 5
penalty units.

"(2) For an offence prescribed in regulation 9.4.01 for which a person may be,
or has been, given a notice under subsection 1313 (1) of the Corporations Law,
the amount of the penalty is:

   (a)  if the person is an individual-2.5 penalty units; and

   (b)  if the person is a body corporate-12.5 penalty units.".
