EXPLANATORY MEMORANDUM



Outline

This Bill sets out a series of amendments to the Civil Law (Wrongs) Act 2002 to incorporate domestic relationships within the principal act.


Revenue/Cost Implications


There is no additional cost involved in the Bill.

Formal Clauses

Part 1- Preliminary


Clauses 1 and 2 are formal requirements. They deal with the short title of the Bill, and the commencement provisions.

Clause 3 identifies the Act being amended.

Clause 4 adds the definition of ‘domestic relationship’ to the definition of ‘member of a dead person’s family’ applicable to section 3.1 of the Act. The definition of ‘domestic relationship’ is the same as in the Domestic Relationships Act 1994.


Clause 5 inserts a new provision that includes a person in a domestic relationship as a member of the dead person’s family, if they were in a domestic relationship immediately prior to the death.

Clause 6 adds the definition of ‘domestic relationship’ to the definition of ‘family member’ applicable to section 3.2 of the Act. The definition of ‘domestic relationship’ is the same as in the Domestic Relationships Act 1994.

Clause 7 inserts a new provision that includes a person in a domestic relationship as a member of the person’s family, if they were in a domestic relationship.
