A Bill for

An Act to amend the Civil Law (Wrongs) Act 2002











The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Civil Law (Wrongs) Amendment Act 2002 (No 2).

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act 2001, s 75 (1)).

3 Act amended

This Act amends the Civil Law (Wrongs) Act 2002.

4 Section 20, new definition of domestic relationship

insert

domestic relationship means a personal relationship (other than a legal or de facto marriage relationship) between 2 adults in which one provides personal or financial commitment and support of a domestic nature for the material benefit of the other.

5 Section 20, definition of member, paragraph (h)

substitute

(h) a former spouse of the person;

(i) a person who, immediately before the death, was in a domestic relationship with the person.

6 Section 29, new definition of domestic relationship

insert

domestic relationship means a personal relationship (other than a legal or de facto marriage relationship) between 2 adults in which one provides personal or financial commitment and support of a domestic nature for the material benefit of the other.

7 Section 29, definition of family member, paragraph (d)

substitute

(d) a brother, sister, half-brother or half-sister of the person; or

(e) a person who is in a domestic relationship with the person.
