(1) A person is
eligible to be appointed as the exploration manager of a mine if the
person —
(a)
passes an applicable legislation examination for exploration managers; and
(b)
successfully completes an approved WHS risk management unit; and
(c)
works at a mine or in mining exploration for at least 2 years.
(2) The appointment of
a person as the exploration manager of a mine must be in the approved form and
in the manner approved by the regulator.
(3) If a person ceases
to be the exploration manager of a mine, the mine operator of the mine must
appoint a person who meets the requirements of subregulation (1) as the
exploration manager of the mine.
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
