(1) The mine operator
of a mine must make the necessary financial and other provisions to ensure, so
far as is practicable, that the mine is planned, designed, constructed,
managed and operated in accordance with the Act.
(2) The mine operator
of a mine must ensure, so far as is reasonably practicable, that there is
minimum risk to the health and safety of persons from the mine and anything
arising from the mine.
(3) The duties imposed
under subregulations (1) and (2) are not limited by other provisions
of these regulations that impose duties on another person in relation to the
operation of a mine.
