(1) This regulation
applies if a person gives the regulator 1 of the following notices (each a
mining operation notice ) —
(a) a
mining commencement notice under regulation 675UC(2);
(b) an
additional operations notice under regulation 675UD(2).
(2) The regulator may
give the person a written notice, in an approved form and in a manner approved
by the regulator —
(a)
requiring the person to —
(i)
clarify the contents of the mining operation notice; or
(ii)
give supplementary information or documents in relation
to the mining operation the subject of the mining operation notice;
and
(b)
requiring the person to give the clarification, supplementary information or
documents to the regulator —
(i)
if practicable, before the mining operation the subject
of the mining operation notice commences; or
(ii)
otherwise — as soon as practicable after the
mining operation the subject of the mining operation notice commences;
and
(c)
stating that the person commits an offence if they fail to comply with the
notice.
(3) A person who
receives a written notice under subregulation (2) must comply with the
notice.
Penalty for this subregulation:
(a) for
an individual, a fine of $4 200;
(b) for
a body corporate, a fine of $21 000.
(4) Any clarification,
supplementary information or document that is required to be given to the
regulator under this regulation must be given in, and include information
required by, an approved form and in a manner approved by the regulator.
