(1) The mine operator
of an underground mine must ensure that, if 2 working faces are
approaching each other at the mine, 1 of the workings is stopped, made safe
and barricaded as soon as practicable before the distance separating the faces
creates a risk to health or safety.
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
(2) The mine operator
of an underground mine, before connecting any underground mine workings to any
other workings (including disused workings), must ensure —
(a) if
it is possible to inspect the other workings — that the other
workings are inspected for water, gas, misfires, butts and any other
circumstance that may be a risk to the health or safety of any person at the
mine; or
(b)
otherwise — that all other reasonably practicable steps are taken
to ascertain whether any of the hazards referred to in paragraph (a)
exist.
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
