(1) The mine operator
of a mine must ensure that the concentration of any airborne contaminant
(including any asphyxiant or explosive gas) at the mine is as low as is
reasonably practicable.
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
(2) The mine operator
must comply with subregulation (1) —
(a) so
far as is reasonably practicable, by suppression or the installation of a
ventilation or exhaust extraction system; or
(b) so
far as that is not reasonably practicable, by some other suitable means.
(3) This regulation
does not limit regulation 49.
