(1) The mine operator
of a mine must identify all principal mining hazards at the mine.
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
(2) The mine operator
of a mine must conduct, in relation to each principal mining hazard identified
at the mine, a risk assessment that involves a comprehensive and systematic
investigation and analysis of all aspects of risk to health and safety
associated with the principal mining hazard.
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
(3) The mine operator
of a mine, in conducting a risk assessment under subregulation (2),
must —
(a) use
investigation and analysis methods that are appropriate to the principal
mining hazard being considered; and
(b)
consider the principal mining hazard individually and also cumulatively with
other hazards at the mine.
