(1) The regulator may
issue a written notice to a person who is a person conducting a business or
undertaking at a workplace, directing the person —
(a) to
conduct tests to ascertain if asbestos is present in the workplace in such
manner set out in the direction; or
(b) to
cause any ACM at the workplace to be removed if it was installed on or after
31 December 2003.
(2) A person must
comply with each direction issued to the person under subregulation (1).
Penalty for this subregulation:
(a) for
an individual, a fine of $7 000;
(b) for
a body corporate, a fine of $35 000.
(3) The regulator is
not liable for any costs in relation to the tests or asbestos removal work.
