(1) A permit authority may refuse an application for a building permit under section 139 if the permit authority considers the refusal to be reasonable in the circumstances.(2) A permit authority must refuse an application for a building permit under section 139 if the permit authority is satisfied that (a) the proposed permit building work will not comply with this Act; or(b) all appropriate protection work has not been, or will not be, performed in respect of the work; or(c) the proposed permit building work will not be performed by a licensed builder where required; or(d) the responsible person for the work does not meet the requirements of section 5.(3) If a permit authority refuses an application for a building permit under section 139 , the permit authority must notify the applicant in writing of (a) the refusal of the application; and(b) the reason for the refusal of the application; and(c) the right of appeal under this Act in respect of the decision to refuse the application.
