1994 A BILL FOR An Act to amend the Transport Infrastructure Act 1994, and for other purposes
s1 4 s5 Transport Infrastructure Amendment (No. 2) The Parliament of Queensland enacts-- 1 title 2 Short 1. This Act may be cited as the Transport Infrastructure Amendment Act 3 (No. 2) 1994. 4 5 Commencement 2. This Act commences on a day to be fixed by proclamation. 6 Act 7 Amended 3. This Act amends the Transport Infrastructure Act 1994. 8 of s 20 (Definitions) 9 Amendment 4. Section 20(1)-- 10 insert-- 11 ` "franchised road" means a road to which a road franchise agreement1 12 applies, and includes facilities identified in the road franchise 13 agreement that are on or adjacent to the road and relate to the operation 14 or servicing of the road or facilities for road users. 15 "franchisee" means a person with whom the Minister has entered into a 16 road franchise agreement. 17 "road franchise agreement" see section 61AB.'. 18 of new Part 19 Insertion 5. Chapter 5, after Part 5-- 20 insert-- 21 1 Road franchise agreements are entered into under section 61AB.
s5 5 s5 Transport Infrastructure Amendment (No. 2) `PART 6--FRANCHISED ROADS 1 of Part 2 `Objectives `61AA. The objectives of this Part are-- 3 (a) to assist and encourage private investment in the construction, 4 maintenance and operation of road transport infrastructure; and 5 (b) by the involvement of private investment, to enable road transport 6 infrastructure projects to be undertaken at an earlier time than 7 would otherwise be possible; and 8 (c) to provide an appropriate management structure for the 9 construction, maintenance and operation of road transport 10 infrastructure on a commercial basis. 11 to enter into road franchise agreements 12 `Power `61AB.(1) The Minister may, for the State, enter into an agreement (a 13 "road franchise agreement") with a person under which, or as part of 14 which, the person is to invest in the construction, maintenance or operation 15 of road transport infrastructure. 16 `(2) The agreement must be consistent with-- 17 (a) the Coordination Plan; and 18 (b) the objectives of this Act; and 19 (c) the current transport infrastructure strategies; and 20 (d) the obligations about government supported transport 21 infrastructure set out in section 10. 22 `(3) The agreement may include, for example-- 23 (a) provisions about the ownership of the road transport 24 infrastructure; or 25 (b) provisions about tolls for the use of the road transport 26 infrastructure. 27
s5 6 s5 Transport Infrastructure Amendment (No. 2) of road franchise agreements 1 `Tabling `61AC. The Minister must table each road franchise agreement, and each 2 amendment of a road franchise agreement, in the Legislative Assembly as 3 soon as practicable after it is entered into. 4 on operation of Part 5 `Report `61AD. Each annual report of the department must include a report on 6 the operation of this Part during the financial year to which the report 7 relates. 8 of money 9 `Recovery `61AE. If a road franchise agreement provides that the Minister may 10 recover an amount from a franchisee, the amount may be recovered as a 11 debt payable by the franchisee to the State. 12 of land 13 `Rateability `61AF.(1) In this section-- 14 "road franchise agreement land" means land on which is situated road 15 transport infrastructure to which a road franchise agreement applies. 16 `(2) A regulation may provide that land is not rateable under the Local 17 Government Act 1993 or the City of Brisbane Act 1924. 18 of chief executive to lease or dispose of land to franchisees 19 `Power `61AG.(1) In this section-- 20 "required land" means land that-- 21 (a) has been acquired for transport purposes or an incidental purpose; 22 and 23 (b) is required for road transport infrastructure for a road to which a 24 road franchise agreement applies. 25 `(2) The chief executive may, for the State, lease, sell or otherwise 26 dispose of the required land to the franchisee of the road franchise 27
s5 7 s5 Transport Infrastructure Amendment (No. 2) agreement. 1 `(3) This section has effect despite the Acquisition of Land Act 1967. 2 of other provisions of this Chapter 3 `Application `61AH.(1) The provisions of the other Parts of this Chapter, and of 4 regulations made for this Chapter, apply to a franchised road as if it were a 5 State-controlled road. 6 `(2) A regulation may-- 7 (a) prescribe changes to the way the provisions apply to a particular 8 franchised road; or 9 (b) declare that some of the provisions do not apply to a particular 10 franchised road. 11 undertakings and stamp duty 12 `Guarantees, `61AI. For the purpose of giving guarantees, undertakings or stamp duty 13 exemptions to a franchisee, the following sections of the Statutory Bodies 14 Financial Arrangements Act 1982 apply, with all necessary changes and 15 any changes prescribed by regulation, to the franchisee as if the franchisee 16 were a statutory body within the meaning of the Act-- 17 · section 16 (Treasurer's guarantee) 18 · section 18 (Requirement for security) 19 · section 19 (Guarantee not affected by transfer of liability) 20 · section 20 (Recovery of moneys paid under guarantee) 21 · section 21 (This Part does not relieve statutory bodies from 22 conditions precedent) 23 · section 38 (Exemption from stamp duty). 24 roads to be roads for other purposes 25 `Franchised `61AJ. A franchised road is a road for the purposes of the Transport 26 Infrastructure (Roads) Act 1991.'. 27

Part 1, after section 89-- 9 insert-- 10 `Existing franchised road 11 `89A.(1) In this section-- 12 "repealed Act" means-- 13 (a) the Gateway Bridge Agreement Act 1980; or 14 (b) the Motorways Agreements Act 1987. 15 `(2) An agreement in force under a repealed Act immediately before the 16 commencement has effect under this Act as if it were a road franchise 17 agreement. 18 `(3) However, section 61AC (Tabling of road franchise agreements) 19 does not apply to the agreement. 20 `(4) A by-law in force under a repealed Act immediately before the 21 commencement-- 22 (a) remains in force for the purposes of this Act, subject to 23 amendment or repeal by a regulation under this Act; and 24 (b) is to be read with the changes necessary to make it consistent with 25 this Act and adapt its operation to the provisions of this Act. 26

In the next reprint of the Act produced under the Reprints 22 Act 1992, section 43 (Numbering and renumbering of provisions) of that 23 Act must be used.'. 24
