2001 A BILL FOR An Act to amend the Tobacco and Other Smoking Products (Prevention of Supply to Children) Act 1998, and for other purposes

 


 

s1 8 s4 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 The Parliament of Queensland enacts-- 1 PART 1--PRELIMINARY 2 1 Short title Clause 3 This Act may be cited as the Tobacco and Other Smoking Products 4 (Prevention of Supply to Children) Amendment Act 2001. 5 2 Commencement Clause 6 (1) If this section has not commenced by 31 May 2001, sections 3 and 48 7 are taken to have commenced on 31 May 2001. 8 (2) Part 2 (other than sections 3, 29 and 48), part 3 and sections 53(1), 54(1), (3) and (4) commence on 31 May 2002. 1 90 PART 2--AMENDMENT OF TOBACCO AND OTHER 11 SMOKING PRODUCTS (PREVENTION OF SUPPLY TO 12 CHILDREN) ACT 1998 13 3 Act amended in pt 2 Clause 14 This part amends the Tobacco and Other Smoking Products (Prevention 15 of Supply to Children) Act 1998. 16 4 Replacement of title Clause 17 Title-- 18 omit, insert-- 19 `An Act to restrict the supply of tobacco and other smoking products 20 to children, to restrict advertising and promotion of tobacco and 21 other smoking products, to prohibit smoking in certain places, 22 and for other purposes'. 23

 


 

s5 9 s7 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 5 Replacement of s 1 (Short title) Clause 1 Section 1-- 2 omit, insert-- 3 `1 Short title 4 `This Act may be cited as the Tobacco and Other Smoking Products Act 5 1998.'. 6 6 Replacement of s 3 (Main object of Act and its achievement) Clause 7 Section 3-- 8 omit, insert-- 9 `3 Object of Act 10 `The object of this Act is to improve the health of members of the public 11 by reducing their exposure to tobacco and other smoking products. 12 `3A How object is to be achieved 13 `The object is to be achieved mainly by-- 14 (a) restricting the supply of tobacco and other smoking products to 15 children; and 16 (b) restricting the advertising and promotion of tobacco and other 17 smoking products; and 18 (c) reducing public exposure to smoke from tobacco and other 19 smoking products; and 20 (d) establishing a framework for monitoring, investigative and 21 enforcement activities.'. 22 7 Insertion of new s 9A Clause 23 After section 9-- 24 insert-- 25

 


 

s8 10 s 10 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `9A Supplier must take prevention measures 1 `(1) A supplier must take prevention measures in relation to employees 2 of the supplier. 3 Maximum penalty--20 penalty units. 4 `(2) In this section-- 5 "employee", of a supplier, means a person who supplies, or may supply, 6 smoking products in the course of the person's employment.'. 7 Clause 8 Amendment of s 10 (Individual supplier must not supply smoking 8 products to children) 9 Section 10(1), penalty-- 10 omit, insert-- 11 `Maximum penalty-- 12 (a) for a first offence--70 penalty units; and 13 (b) for a second or later offence--140 penalty units.'. 14 9 Amendment of s 11 (Supplier must ensure employees do not 15 Clause supply smoking products to children) 16 Section 11(1), penalty-- 17 omit, insert-- 18 `Maximum penalty-- 19 (a) for a first offence--70 penalty units; and 20 (b) for a second or later offence--140 penalty units.'. 21 10 Amendment of s 12 (When employee of supplier liable) Clause 22 Section 12(2)-- 23 omit, insert-- 24 `(2) After the prevention measures have been taken, the employee of the 25 supplier must not, in the course of the employee's employment, supply a 26 smoking product to a child. 27 Maximum penalty-- 28

 


 

s 11 11 s 12 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 (a) for a first offence--10 penalty units; and 1 (b) for a second offence--20 penalty units.'. 2 11 Amendment of s 13 (Suppliers may be prohibited from selling Clause 3 smoking products) 4 Section 13(5), penalty-- 5 omit, insert-- 6 `Maximum penalty for subsection (5)--200 penalty units.'. 7 12 Replacement of ss 14 and 15 Clause 8 Sections 14 and 15-- 9 omit, insert-- 10 `14 Definitions for div 2 11 `In this division-- 12 "bar" means a place in licensed premises that-- 13 (a) is stocked with liquor of various types; and 14 (b) is used solely or mainly for the supply of liquor to customers; 15 and 16 (c) has a counter-- 17 (i) across which liquor is supplied directly to customers; and 18 (ii) at which, or in the immediate vicinity of which, customers 19 may immediately consume the liquor supplied. 20 "bar area", of licensed premises, means the area-- 21 (a) in the immediate vicinity of a bar; and 22 (b) not more than 5 m from the outer edge of the counter of the bar. 23 "employee", of a person in charge of a tobacco product vending machine, 24 means an employee of the person-- 25 (a) whose employment requires the employee to work near the 26 vending machine; and 27 (b) who, in performing the employee's duties, can observe the use of 28 the vending machine. 29

 


 

s 12 12 s 12 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 "gaming machine area" has the meaning given by the Gaming Machine 1 Act 1991, section 2.1 2 "liquor" has the meaning given by the Liquor Act 1992, section 4B. 3 "prevention measures", by a person in charge of a tobacco product 4 vending machine, means, for the person's employees-- 5 (a) instructing the employees to-- 6 (i) take reasonable steps to ensure that a child does not 7 obtain a tobacco product from the vending machine, 8 even if the product is for, or claimed to be for, an adult; 9 and 10 (ii) sight acceptable evidence of age for a person before 11 allowing the person to obtain a tobacco product from 12 the vending machine, unless satisfied the person is an 13 adult; and 14 (b) obtaining written acknowledgment by each employee that 15 the employee received the instructions mentioned in 16 paragraph (a). 17 `15 Restriction on location of tobacco product vending machines 18 `(1) An occupier of premises must not have a tobacco product vending 19 machine in the premises. 20 Maximum penalty--70 penalty units. 21 `(2) Subsection (1) does not apply to-- 22 (a) a bar area of licensed premises if each tobacco product vending 23 machine in the area can be easily observed by persons working 24 behind the bar; or 25 (b) a casino; or 26 (c) a gaming machine area, if each tobacco product vending machine 27 in the area can be easily observed by employees of the person in 28 charge of the tobacco product vending machine. 29 1 Gaming Machine Act 1991, section 2-- "gaming machine area" means any location on licensed premises where a licensee is permitted to install a gaming machine.

 


 

s 13 13 s 14 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `(3) Also, subsection (1) does not apply to a tobacco product vending 1 machine while it is not being used by anyone to supply tobacco products. 2 3 Example-- 4 Subsection (1) does not apply to a tobacco product vending machine while it is being 5 stored, transported or repaired. `(4) In a prosecution for an offence against subsection (1), proof that a 6 tobacco product vending machine was capable of being used to supply 7 tobacco products is evidence that the vending machine was being used to 8 supply tobacco products at the relevant time. 9 `15A Person in charge of tobacco product vending machine in bar 10 area or gaming machine area must instruct employees 11 `A person in charge of a tobacco product vending machine in a bar area 12 or gaming machine area must take prevention measures in relation to the 13 person's employees. 14 Maximum penalty--20 penalty units.'. 15 13 Amendment of s 16 (Supply of tobacco products from Clause 16 vending machines) 17 Section 16(1), penalty-- 18 omit, insert-- 19 `Maximum penalty-- 20 (a) for a first offence--70 penalty units; and 21 (b) for a second or later offence--140 penalty units.'. 22 14 Amendment of s 17 (Persons in charge of tobacco product vending Clause 23 machines may be prohibited from possessing tobacco product 24 vending machines) 25 Section 17(5), penalty-- 26 omit, insert-- 27 `Maximum penalty for subsection (5)--200 penalty units.'. 28

 


 

s 15 14 s 18 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 15 Amendment of s 18 (Prohibition on use of vending machine to Clause 1 supply herbal cigarettes and loose smoking blends) 2 Section 18(1), penalty-- 3 omit, insert-- 4 `Maximum penalty-- 5 (a) for a first offence--70 penalty units; and 6 (b) for a second or later offence--140 penalty units.'. 7 16 Amendment of s 18A (Application of div 3A) Clause 8 Section 18A(a)(ii)-- 9 omit, insert-- 10 `(ii) employees of suppliers in the course of the employees' 11 employment; or'. 12 17 Amendment of s 19 (Supply prohibited) Clause 13 Section 19(1), penalty-- 14 omit, insert-- 15 `Maximum penalty--70 penalty units.'. 16 18 Replacement of s 20 (Supplier of tobacco products must display Clause 17 prohibition signs) 18 Section 20-- 19 omit, insert-- 20 `20 Supplier must display a prohibition sign 21 `(1) A supplier must display a prohibition sign for the supplier's point of 22 sale as prescribed under a regulation. 23 Maximum penalty--10 penalty units. 24 `(2) However, this section does not apply if the point of sale is a tobacco 25 product vending machine.'. 26

s 26 17 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `26B Location of display of smoking products 1 `(1) A display of smoking products may only be located-- 2 (a) at a point of sale; and 3 (b) either-- 4 (i) on the seller's side of the point of sale; or 5 (ii) above or below a counter where customers are served, in a 6 way that the smoking products can not be accessed by 7 customers without the help of the supplier or an employee 8 of the supplier. 9 `(2) Smoking products must not be located on a counter where 10 customers are served at a point of sale. 11 `(3) However, a display of cigars may be located other than at a point of 12 sale if the cigars-- 13 (a) are in a humidified container that can be accessed only by a 14 supplier or an employee of the supplier; or 15 (b) are kept in a humidified room where the cigars can be accessed 16 by a customer but only if, while the customer is in the room, the 17 customer is accompanied by the supplier or employee. 18 `(4) Also, a duty free shop may display a smoking product anywhere in 19 the shop. 20 `(5) This section does not apply to a tobacco product vending machine. 21 `(6) In this section-- 22 "humidified container", for cigars, means a container in which the 23 humidity is controlled to preserve the quality of the cigars. 24 "humidified room", for cigars, means a room in which the humidity is 25 controlled to preserve the quality of the cigars. 26 `26C Availability for sale of displayed products 27 `The only smoking products that may be displayed at a retail outlet are 28 the smoking products available for sale, or usually available for sale, at the 29 retail outlet. 30

 


 

s 26 18 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `26D Manner of display of immediate package of smoking product 1 `(1) A display of a product line of an immediate package of a smoking 2 product may consist of the display of the product line in 1 only of the 3 following ways-- 4 (a) by the display of a single immediate package of the product line 5 in the form in which the package is available, or usually 6 available, for sale; 7 (b) by a stack dispenser for immediate packages of the product line 8 that complies with subsection (2); 9 (c) by a single representation of the immediate package of the 10 product line in the form in which the package is available, or 11 usually available, for sale that-- 12 (i) is no larger than the actual size of the package, with the 13 same appearance as the package; and 14 (ii) includes a representation of the health warning with which 15 the package is required to be labelled under the Trade 16 Practices (Consumer Product Information Standards) 17 (Tobacco) Regulations (Cwlth). 18 `(2) The display of a product line of a smoking product by a stack 19 dispenser for immediate packages of the product line is permitted in 1 only 20 of the following ways-- 21 (a) by stacking immediate packages directly behind each other, 22 whether horizontally, or on an angle to the horizontal, in a way 23 that the most that is displayed is-- 24 (i) a face and the top, sides and bottom of a single immediate 25 package at the front of the stack (from the point of view of 26 the customer); and 27 (ii) the tops, sides and bottoms of the other immediate packages 28 in the stack; 29 (b) by stacking immediate packages on top of each other so that only 30 1 package in the stack, and no part of any other package in the 31 stack, is displayed. 32 `(3) In this section-- 33 "stack dispenser" means the following, from which smoking products 34 may be taken by a supplier, or an employee of a supplier, for sale to a 35 person, but does not include a tobacco product vending machine-- 36

 


 

s 26 19 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 (a) a device containing smoking products; 1 (b) a stack or other arrangement of smoking products not contained 2 in a device. 3 `26E Manner of display of individual cigars 4 `A display of a product line of cigars consisting of individual cigars may 5 only consist of a maximum of 13 cigars. 6 `26F Manner of display of cartons of smoking products 7 `(1) A display of a product line of a carton of a smoking product may 8 only consist of the display of a single carton of the product line in the form 9 in which the carton is available, or usually available, for sale. 10 `(2) However, a duty free shop may display more than 1 carton of a 11 product line of a smoking product. 12 `26G When display must not constitute advertisement 13 `(1) A display of smoking products must not consist of a display of the 14 products, or representations of the products, that constitute a tobacco 15 advertisement itself as distinct from the display or representation allowed 16 under this division. 17 `(2) Packages of smoking products must not be arranged in a way that 18 creates a composite picture or other meaningful visual image whose 19 component parts are printed on individual packages. 20 `26H Display of retail prices of smoking product 21 `A display of smoking products may include the retail price of the 22 products only if the price is displayed in 1 or both of the following ways-- 23 (a) by a price ticket, or other indicator of price for each product line, 24 as prescribed under a regulation; 25 (b) by a single price board for product lines prescribed under a 26 regulation. 27

 


 

s 26 20 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `Division 2--Quit smoking signs 1 `26I Mandatory quit smoking sign 2 `(1) A supplier must display a quit smoking sign for the supplier's point 3 of sale as prescribed under a regulation. 4 Maximum penalty--10 penalty units. 5 `(2) In this section-- 6 "quit smoking sign" means a sign designed to encourage a person who 7 smokes, to stop smoking. 8 `Division 3--Promotions of smoking products 9 `26J Definitions for div 3 10 `In this division-- 11 "entitlement" means an entitlement to goods or services, or to a reduced 12 price for goods or services. 13 "object" includes a document and does not include a smoking product. 14 `26K When division does not apply 15 `This division does not prevent a promotion of a smoking product by a 16 manufacturer or distributor if the promotion is only to a supplier. 17 `26L Supply of object or entitlement that promotes smoking product 18 etc. 19 `(1) A person must not supply an object or entitlement that promotes-- 20 (a) a smoking product; or 21 (b) a trademark or brand name, or part of a trademark or brand name, 22 of a smoking product; or 23 (c) the name or interests of a manufacturer or distributor of a 24 smoking product in association, whether directly or indirectly, 25 with the smoking product. 26 Maximum penalty--70 penalty units. 27

 


 

s 26 21 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `(2) In a prosecution for an offence against subsection (1), to establish 1 whether an object or entitlement promotes a matter-- 2 (a) it is enough to prove-- 3 (i) that material published by the defendant relating to the 4 object or entitlement would be likely to cause a reasonable 5 person to believe the object or entitlement promoted, or was 6 intended to promote, the matter; or 7 (ii) that there are other reasonable grounds for believing the 8 object or entitlement promoted, or was intended to promote, 9 the matter; and 10 (b) the matter may be found to be promoted by the object or 11 entitlement irrespective of the actual belief of the defendant. 12 `(3) In this section-- 13 "promotes", in relation to the promotion of a matter by an object that is a 14 sound recording, video recording or a computer storage device, 15 includes the promotion of the matter by aural or visible material that 16 the object is reasonably capable of producing, or causing to be 17 produced, in its normal use. 18 `26M Supply of object or entitlement in association with 19 smoking product sale or consumption 20 `(1) A person must not supply an object or entitlement if the supply is in 21 direct or indirect association with the sale or consumption of a smoking 22 product, or of smoking products generally. 23 Maximum penalty--70 penalty units. 24 `(2) In a prosecution for an offence against subsection (1), to establish 25 whether an object or entitlement is supplied in direct or indirect association 26 with a matter-- 27 (a) it is enough to prove-- 28 (i) that material published by the defendant relating to the 29 object or entitlement would be likely to cause a reasonable 30 person to believe the supply to be in that association, or 31 intended to be in that association; or 32 (ii) that there are other reasonable grounds for believing the 33 supply to be in that association, or intended to be in that 34 association; and 35

 


 

s 26 22 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 (b) the supply may be found to be in that association irrespective of 1 the actual belief of the defendant. 2 `(3) It is a defence to a prosecution for an offence against subsection (1), 3 if the defendant proves that the person receiving the object or entitlement 4 would have received the same object or entitlement if the person had 5 bought goods of whatever kind other than a smoking product to the same 6 value as the smoking product. 7 `26N Smoking product giveaways 8 `(1) A person must not supply a smoking product for free if the supply 9 promotes the sale of a smoking product. 10 Maximum penalty--70 penalty units. 11 `(2) In a prosecution for an offence against subsection (1), to establish 12 whether the supply of a smoking product for free promotes the sale of a 13 smoking product-- 14 (a) it is enough to prove-- 15 (i) that material published by the defendant relating to the 16 supply would be likely to cause a reasonable person to 17 believe the supply promoted, or was intended to promote, 18 the sale; or 19 (ii) that there are other reasonable grounds for believing the 20 supply promoted, or was intended to promote, the sale; and 21 (b) the sale may be found to be promoted by the supply irrespective 22 of the actual belief of the defendant. 23 `26O Competition that promotes smoking product 24 `(1) A person must not conduct a competition that promotes-- 25 (a) a smoking product; or 26 (b) a trademark or brand name, or part of a trademark or brand name, 27 of a smoking product; or 28 (c) the name or interests of a manufacturer or distributor of a 29 smoking product in association, whether directly or indirectly, 30 with the smoking product. 31 Maximum penalty--70 penalty units. 32

 


 

s 26 23 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `(2) In a prosecution for an offence against subsection (1), to establish 1 whether a competition promotes a matter-- 2 (a) it is enough to prove-- 3 (i) that material published by the defendant relating to the 4 competition would be likely to cause a reasonable person to 5 believe the competition promoted, or was intended to 6 promote, the matter; or 7 (ii) that there are other reasonable grounds for believing the 8 competition promoted, or was intended to promote, the 9 matter; and 10 (b) the matter may be found to be promoted by the competition 11 irrespective of the actual belief of the defendant. 12 `26P Conduct of competition in association with smoking 13 product sale or consumption 14 `(1) A person must not conduct a competition that has a direct or indirect 15 association with the sale or consumption of a smoking product, or of 16 smoking products generally. 17 Maximum penalty--70 penalty units. 18 `(2) In a prosecution for an offence against subsection (1), to establish 19 whether a competition has a direct or indirect association with a matter-- 20 (a) it is enough to prove-- 21 (i) that material published by the defendant relating to the 22 competition would be likely to cause a reasonable person to 23 believe the competition to have that association, or to be 24 intended to have that association; or 25 (ii) that there are other reasonable grounds for believing the 26 competition to have that association, or to be intended to 27 have that association; and 28 (b) the competition may be found to have that association 29 irrespective of the actual belief of the defendant. 30

 


 

s 26 24 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `PART 2B--SMOKE-FREE ENCLOSED PLACES 1 `26Q Definitions for pt 2B 2 `In this part-- 3 "common area", of multi-unit residential accommodation, means an area 4 accessible to all, or a specified class of, residents of, or persons 5 employed at, the accommodation. 6 7 Example-- 8 A TV room or cooking facilities shared by all, or a specified class of, residents. "community titles scheme" has the meaning given by the Body Corporate 9 and Community Management Act 1997, section 11.2 10 "dining area" means an area where meals may be consumed. 11 "enclosed" means-- 12 (a) for a place other than a vehicle or part of a vehicle--having a 13 ceiling or roof and, except for doors and passageways, 14 completely or substantially enclosed, whether permanently or 15 temporarily; or 16 (b) for a place that is a vehicle, or part of a vehicle--having a ceiling 17 or roof and, except for doors and exits, completely or 18 substantially enclosed, whether permanently or temporarily. 19 "exempt vehicle" means a vehicle being used-- 20 (a) for private use; or 21 (b) for business use, if only 1 person is in the vehicle. 22 "gaming table area", for a casino, means an area within 2.4 m of a gaming 23 table at the casino. 24 "licensed premises" means-- 25 (a) licensed premises under the Liquor Act 1992; or 26 (b) a place with a permit under the Liquor Act 1992, section 97; or 27 (c) licensed premises under the Wine Industry Act 1994; or 28 (d) a place with a permit under the Wine Industry Act 1994. 29 2 Body Corporate and Community Management Act 1997, section 11 (Meaning of "community titles scheme")

 


 

s 26 25 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 "licensee" means a person who holds a licence or permit for licensed 1 premises. 2 "lot" has the meaning given by the Body Corporate and Community 3 Management Act 1997, schedule 4.3 4 "meal" means food that-- 5 (a) is eaten by a person sitting at a table, or fixed structure used as a 6 table, with cutlery provided for the purpose of eating the food; 7 and 8 (b) is of adequate substance as to be ordinarily accepted as a meal. 9 "multi-unit residential accommodation" means motels, hostels, boarding 10 houses, nursing homes, residential accommodation comprising lots in 11 a community titles scheme and other similar accommodation. 12 "occupier", of an enclosed place or part of an enclosed place, means a 13 person having the management or control, or otherwise being in 14 charge, of the place or part. 15 "premium gaming room" means a room of a casino where-- 16 (a) minimum or maximum bets are generally higher than elsewhere 17 in the casino; and 18 (b) food or drink are generally provided free to casino patrons. 19 "residential premises" means premises used, or intended to be used, as a 20 place of residence or mainly as a place of residence and does not 21 include multi-unit residential accommodation. 22 "smoke" means smoke, hold or otherwise have control over an ignited 23 smoking product. 24 `26R Person must not smoke in enclosed place 25 `(1) A person must not smoke in an enclosed place. 26 Maximum penalty--20 penalty units. 27 `(2) Subsection (1) does not apply to the following-- 28 (a) residential premises, other than a part of residential premises 29 being used for carrying on a business while 1 or more persons 30 3 Body Corporate and Community Management Act 1997, schedule 4 (Dictionary)

 


 

s 26 26 s 26 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 who do not reside at the premises are present in the part of the 1 premises; 2 3 Example of a person who does not reside at the premises-- 4 A person employed in the business. (b) multi-unit residential accommodation, other than the common 5 areas of the accommodation; 6 (c) an exempt vehicle; 7 (d) a premium gaming room; 8 (e) licensed premises other than the following areas of the 9 premises-- 10 (i) dining areas while meals are available for consumption or 11 being consumed; 12 (ii) gaming table areas of a casino; 13 (f) a secure facility under the Corrective Services Act 2000. 14 `(3) A person who performs in a theatre or other enclosed place does not 15 commit an offence under this section by smoking during the performance if 16 smoking is part of the performance. 17 `26S No smoking sign 18 `A licensee of licensed premises containing a dining area or gaming table 19 area mentioned in section 26R(2)(e) must display a no smoking sign for the 20 area, as prescribed under a regulation. 21 Maximum penalty--10 penalty units. 22 `26T No right to smoke in enclosed place 23 `(1) To remove any doubt, it is declared that this part does not create or 24 preserve a right for a person to smoke in an enclosed place. 25 `(2) Also, nothing in this part affects the operation of another Act to the 26 extent that the other Act prohibits smoking at any place. 27 `26U Person smoking must stop when directed 28 `A person contravening section 26R must comply with a direction to stop 29 the contravention by-- 30

 


 

s 27 27 s 27 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 (a) an authorised person;4 or 1 (b) an occupier of an enclosed place where the contravention is 2 happening, or an employee or agent of the occupier. 3 Maximum penalty--20 penalty units. 4 `26V Offence by occupier 5 `(1) If a person contravenes section 26R, an occupier of the enclosed 6 place where the contravention happens commits an offence. 7 Maximum penalty--20 penalty units. 8 `(2) However, it is a defence for the occupier to prove-- 9 (a) the occupier was not aware, and could not have reasonably been 10 expected to be aware, that the contravention was happening; or 11 (b) the occupier, or an employee or agent of the occupier-- 12 (i) directed the person to stop smoking; and 13 (ii) told the person it was an offence not to comply with a 14 direction to stop smoking.'. 15 27 Replacement of s 28 (Terms of appointment) Clause 16 Section 28-- 17 omit, insert-- 18 `28 Appointment conditions 19 `(1) An authorised person holds office on the conditions stated in the 20 instrument of appointment. 21 `(2) An authorised person ceases holding office-- 22 (a) if the appointment provides for a term of appointment--at the 23 end of the term; or 24 (b) if the conditions of appointment provide--on ceasing to hold 25 another office (the "main office") stated in the appointment 26 conditions. 27 4 See section 40A (Power to direct person to stop smoking).

s 30 29 s 31 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 30 Amendment of s 33 (Entry of places by authorised persons) Clause 1 (1) Section 33(2)(c)-- 2 omit. 3 (2) Section 33-- 4 insert-- 5 `(3) For the purpose of asking the occupier of a place for consent to 6 enter, an authorised person may, without the occupier's consent or a 7 warrant-- 8 (a) enter land around premises at the place to an extent that is 9 necessary to contact the occupier; or 10 (b) enter part of the place the authorised person reasonably considers 11 members of the public ordinarily are allowed to enter when they 12 wish to contact the occupier.'. 13 31 Insertion of new ss 36A and 36B Clause 14 After section 36-- 15 insert-- 16 `36A Special warrants 17 `(1) An authorised person may apply for a warrant (a "special 18 warrant") by phone, fax, radio or another form of communication if the 19 authorised person considers it necessary because of-- 20 (a) urgent circumstances; or 21 (b) other special circumstances, including, for example, the 22 authorised person's remote location. 23 `(2) Before applying for the warrant, the authorised person must prepare 24 an application stating the grounds on which the warrant is sought. 25 `(3) The authorised person may apply for the warrant before the 26 application is sworn. 27 `(4) After issuing the warrant, the magistrate must immediately fax a 28 copy to the authorised person if it is reasonably practicable to fax the copy. 29 `(5) If it is not reasonably practicable to fax a copy to the authorised 30 person-- 31 (a) the magistrate must tell the authorised person-- 32

 


 

s 31 30 s 31 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 (i) what the terms of the warrant are; and 1 (ii) the date and time the warrant was issued; and 2 (b) the authorised person must complete a form of warrant (a 3 "warrant form") and write on it-- 4 (i) the magistrate's name; and 5 (ii) the date and time the magistrate issued the warrant; and 6 (iii) the terms of the warrant. 7 `(6) The facsimile warrant, or the warrant form properly completed by 8 the authorised person, authorises the entry and the exercise of the other 9 powers stated in the warrant issued by the magistrate. 10 `(7) The authorised person must, at the first reasonable opportunity, send 11 to the magistrate-- 12 (a) the sworn application; and 13 (b) if the authorised person completed a warrant form--the 14 completed warrant form. 15 `(8) On receiving the documents, the magistrate must attach them to the 16 warrant. 17 `(9) If-- 18 (a) an issue arises in a proceeding about whether an exercise of a 19 power was authorised by a special warrant; and 20 (b) the warrant is not produced in evidence; 21 the onus of proof is on the person relying on the lawfulness of the exercise 22 of the power to prove a special warrant authorised the exercise of the 23 power. 24 `36B Warrants--procedure before entry 25 `(1) This section applies if an authorised person named in a warrant 26 issued under this division for a place is intending to enter the place under 27 the warrant. 28 `(2) Before entering the place, the authorised person must do or make a 29 reasonable attempt to do the following-- 30 (a) identify himself or herself to a person present at the place who is 31 an occupier of the place by producing the authorised person's 32

 


 

s 32 31 s 32 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 identity card or a copy of another document evidencing the 1 authorised person's appointment; 2 (b) give the person a copy of the warrant or, if the entry is authorised 3 by a facsimile warrant or warrant form mentioned in 4 section 36A(6), a copy of the facsimile warrant or warrant form; 5 (c) tell the person the authorised person is permitted by the warrant 6 to enter the place; 7 (d) give the person an opportunity to allow the authorised person 8 immediate entry to the place without using force. 9 `(3) However, the authorised person need not comply with subsection (2) 10 if the authorised person believes on reasonable grounds that immediate 11 entry to the place is required to ensure the effective execution of the 12 warrant is not frustrated.'. 13 32 Amendment of s 37 (General powers after entering places) Clause 14 (1) Section 37(3)(b), (c) and (f), `in the place'-- 15 omit, insert-- 16 `at the place'. 17 (2) Section 37(3)(d)-- 18 omit, insert-- 19 `(d) take an extract from, or copy, a document at the place; or'. 20 (3) Section 37(3)-- 21 insert-- 22 `(g) require the occupier of the place, or a person at the place, to give 23 the authorised person information to help the authorised person 24 ascertain whether this Act is being complied with.'. 25 (4) Section 37(4) to (6)-- 26 omit, insert-- 27 `(4) When making a requirement mentioned in subsection (3)(f) or (g), 28 the authorised person must warn the person it is an offence to fail to 29 comply with the requirement, unless the person has a reasonable excuse.'. 30

s 40 35 s 40 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `42A Tampering with seized thing 1 `(1) If an authorised person restricts access to a seized thing, a person 2 must not tamper with the thing, or something restricting access to the thing, 3 without an authorised person's approval. 4 Maximum penalty--50 penalty units. 5 `(2) If an authorised person makes seized equipment inoperable, a 6 person must not tamper with the equipment, without an authorised person's 7 approval. 8 Maximum penalty--50 penalty units. 9 `(3) In this section-- 10 "tamper" includes attempt to tamper. 11 `42B Powers to support seizure 12 `(1) To enable a thing to be seized, an authorised person may require the 13 person in control of it-- 14 (a) to take it to a stated reasonable place by a stated reasonable time; 15 and 16 (b) if necessary, to remain in control of it at the stated place for a 17 stated reasonable period. 18 `(2) The requirement-- 19 (a) must be made by written notice; or 20 (b) if for any reason it is not practicable to give the notice, may be 21 made orally and confirmed by written notice as soon as 22 practicable. 23 `(3) A further requirement may be made under this section about the 24 thing if it is necessary and reasonable to make the further requirement. 25 `(4) A person of whom a requirement is made under subsection (1) or (3) 26 must comply with the requirement, unless the person has a reasonable 27 excuse. 28 Maximum penalty for subsection (4)--50 penalty units. 29

 


 

s 41 36 s 41 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `42C Receipt for seized thing 1 `(1) As soon as practicable after an authorised person seizes a thing, the 2 authorised person must give a receipt for it to the person from whom it was 3 seized. 4 `(2) However, if for any reason it is not practicable to comply with 5 subsection (1), the authorised person must leave the receipt at the place of 6 seizure in a conspicuous position and in a reasonably secure way. 7 `(3) The receipt must describe generally each thing seized and its 8 condition. 9 `(4) This section does not apply to a thing if it is impracticable or would 10 be unreasonable to give the receipt (given the thing's nature, condition and 11 value). 12 `42D Forfeiture of seized things 13 `(1) A seized thing is forfeited to the State if the authorised person who 14 seized the thing-- 15 (a) can not find its owner, after making reasonable inquiries; or 16 (b) can not return it to its owner, after making reasonable efforts. 17 `(2) In applying subsection (1)-- 18 (a) subsection (1)(a) does not require the authorised person to make 19 inquiries if it would be unreasonable to make inquiries to find the 20 owner; and 21 (b) subsection (1)(b) does not require the authorised person to make 22 efforts if it would be unreasonable to make efforts to return the 23 thing to its owner. 24 25 Example for paragraph (b)-- 26 The owner of the thing has migrated to another country.'. 41 Insertion of new ss 44A and 44B Clause 27 Part 3, division 4-- 28 insert-- 29

 


 

s 42 37 s 42 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `44A Return of seized things 1 `(1) If a seized thing is not forfeited, the authorised person must return it 2 to its owner-- 3 (a) at the end of 6 months; or 4 (b) if a proceeding for an offence involving the thing is started within 5 6 months--at the end of the proceeding and any appeal from the 6 proceeding. 7 `(2) Despite subsection (1), unless the thing is forfeited, the authorised 8 person must immediately return a thing seized as evidence to its owner if 9 the authorised person stops being satisfied its continued retention as 10 evidence is necessary. 11 `44B Access to seized things 12 `(1) Until a seized thing is forfeited or returned, an authorised person 13 must allow its owner to inspect it and, if it is a document, to copy it. 14 `(2) Subsection (1) does not apply if it is impracticable or would be 15 unreasonable to allow the inspection or copying.'. 16 42 Insertion of new ss 44C-44G Clause 17 Part 3, division 5, before section 45-- 18 insert-- 19 `44C Improvement notices 20 `(1) This section applies if an authorised person reasonably believes a 21 person-- 22 (a) is contravening a provision of this Act; or 23 (b) has contravened a provision of this Act in circumstances that 24 make it likely the contravention will continue or be repeated. 25 `(2) The authorised person may, by written notice (an "improvement 26 notice") given to the person, require the person to remedy-- 27 (a) the contravention or likely contravention; or 28 (b) the things or operations causing the contravention or likely 29 contravention. 30 `(3) The improvement notice must state-- 31

 


 

s 42 38 s 42 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 (a) that the authorised person believes the person-- 1 (i) is contravening a provision of this Act; or 2 (ii) has contravened a provision of this Act in circumstances 3 that make it likely that the contravention will continue or be 4 repeated; and 5 (b) the provision the authorised person believes is being, or has been, 6 contravened; and 7 (c) briefly, how the provision is being, or has been, contravened; and 8 (d) the reasonable steps the person must take to remedy the 9 contravention or likely contravention; and 10 (e) that the person must take the steps within a stated reasonable 11 period. 12 `(4) The person must comply with the notice, unless the person has a 13 reasonable excuse. 14 Maximum penalty for subsection (4)--50 penalty units. 15 `44D Power to require production of written acknowledgment 16 `(1) An authorised person may require a supplier or a person in charge of 17 a tobacco product vending machine to make available for inspection by an 18 authorised person, or produce to the authorised person for inspection, at a 19 reasonable time and place nominated by the authorised person, a written 20 acknowledgment obtained by the supplier or person. 21 `(2) The authorised person may keep the acknowledgment to copy it. 22 `(3) If the authorised person copies an acknowledgment, the authorised 23 person may require the person responsible for keeping the 24 acknowledgment to certify the copy as a true copy of the acknowledgment. 25 `(4) The authorised person must return the acknowledgment to the 26 person as soon as practicable after copying it. 27 `(5) However, if a requirement (an "acknowledgment certification 28 requirement") is made of a person under subsection (3), the authorised 29 person may keep the acknowledgment until the person complies with the 30 requirement. 31 `(6) A requirement under subsection (1) is called an "acknowledgment 32 production requirement". 33

 


 

s 42 39 s 42 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 `(7) In this section-- 1 "written acknowledgment" means a written acknowledgment obtained by 2 a supplier or person in charge of a tobacco product vending machine 3 from an employee of the supplier or person in taking prevention 4 measures mentioned in part 2. 5 `44E Failure to produce acknowledgment 6 `(1) A person of whom an acknowledgment production requirement is 7 made must comply with the requirement, unless the person has a 8 reasonable excuse. 9 Maximum penalty--50 penalty units. 10 `(2) It is not a reasonable excuse for a person not to comply with an 11 acknowledgment production requirement that complying with the 12 requirement might tend to incriminate the person. 13 `44F Failure to certify copy of acknowledgment 14 `A person of whom an acknowledgment certification requirement is 15 made must comply with the requirement, unless the person has a 16 reasonable excuse. 17 Maximum penalty--50 penalty units. 18 `44G Power to require information 19 `(1) This section applies if an authorised person reasonably believes-- 20 (a) an offence against this Act has been committed; and 21 (b) a person may be able to give information about the offence. 22 `(2) The authorised person may, by written notice given to the person, 23 require the person to give information about the offence to the authorised 24 person at a stated reasonable time and place. 25 `(3) The person must comply with a requirement under subsection (2), 26 unless the person has a reasonable excuse. 27 Maximum penalty--50 penalty units. 28 `(4) It is a reasonable excuse for an individual to fail to give information 29 if giving the information might tend to incriminate the individual.'. 30

s 47 41 s 47 Tobacco and Other Smoking Products (Prevention of Supply to Children) Amendment Bill 2001 47 Insertion of new ss 51A and 51B Clause 1 After section 51-- 2 insert-- 3 `51A Responsibility for acts or omissions of representatives 4 `(1) This section applies in a proceeding for an offence against this Act. 5 `(2) If it is relevant to prove a person's state of mind about a particular 6 act or omission, it is enough to show-- 7 (a) the act was done or omitted to be done by a representative of the 8 person within the scope of the representative's actual or apparent 9 authority; and 10 (b) the representative had the state of mind. 11 `(3) An act done or omitted to be done for a person by a representative of 12 the person within the scope of the representative's actual or apparent 13 authority is taken to have been done or omitted to be done also by the 14 person, unless the person proves the person could not, by the exercise of 15 reasonable diligence, have prevented the act or omission. 16 `(4) In this section-- 17 "representative" means-- 18 (a) for a corporation--an executive officer, employee or agent of the 19 corporation; or 20 (b) for an individual--an employee or agent of the individual. 21 "state of mind", of a person, includes-- 22 (a) the person's knowledge, intention, opinion, belief or purpose; 23 and 24 (b) the person's reasons for the intention, opinion, belief or purpose. 25 `51B Executive officers must ensure corporation complies with Act 26 `(1) The executive officers of a corporation must ensure the corporation 27 complies with this Act. 28 `(2) If a corporation commits an offence against a provision of this Act, 29 each of the corporation's executive officers also commits an offence, 30 namely, the offence of failing to ensure the corporation complies with the 31 provision. 32
