1998 A BILL FOR An Act to make minor amendments to the statute law of Queensland
s1 4 s4 Statute Law (Miscellaneous Provisions) The Parliament of Queensland enacts-- 1 title 2 Short 1. This Act may be cited as the Statute Law (Miscellaneous Provisions) 3 Act 1998. 4 5 Commencement 2. This Act commences on the day of assent except so far as is otherwise 6 expressly provided. 7 of Acts--schedule 8 Amendment 3. The schedule amends the Acts mentioned in it. 9 notes 10 Explanatory 4. An explanatory note to a provision of this Act is not part of the Act. 11 12

7 Statute Law (Miscellaneous Provisions) SCHEDULE (continued) 1 Amendments 5 to 8 amend the subsection and paragraphing arrangements for 2 section 17 of the Act to the extent necessary to clarify the operation of a proviso 3 contained in the section. 4 Amendment 9 replaces the plural form of a word with the correct singular form. 5 Amendment 10 updates a reference. CTS INTERPRETATION ACT 1954 6 ´A Amendments 7 1. Section 14A(1)-- 8 omit, insert-- 9 `14A.(1) In the interpretation of a provision of an Act, the interpretation 10 that will best achieve the purpose (or purposes) of the Act or the provision 11 is to be preferred to any other interpretation.'. 12 2. Section 38(2) and (3)-- 13 omit, insert-- 14 `(2) If the time, or last day of a period, calculated forwards that is 15 provided or allowed by an Act for doing anything falls on an excluded day, 16 the time, or last day, is taken to fall on the next day later that is not an 17 excluded day. 18 `(3) If the time, or first day of a period, calculated backwards that is 19 provided or allowed by an Act for doing anything falls on an excluded day, 20 the time, or first day, is taken to fall on the next day earlier that is not an 21 excluded day.'. 22 3. 8 Statute Law (Miscellaneous Provisions) SCHEDULE (continued) "excluded day"-- 1 (a) for filing or registering a document--means a day on which the 2 office is closed where the filing or registration is to be or may be 3 done; or 4 (b) otherwise--means a day that is not a business day in the place in 5 which the thing is to be or may be done.'. 6 7 Explanatory notes 8 Amendment 1 ensures that the purposive approach may be applied to a provision of 9 the Act. 10 Amendment 2 reflects the intent of s 29(3) of the Acts Interpretation Act 1931 (Tas). 11 It makes specific provision for the backwards calculation of time and applies the 12 provisions to a date as well as a period of time. 13 Amendment 3 is consequential on amendment 2. MBULANCE SERVICE ACT 1991 14 ´A Amendment 15 1. Section 33(2), `Art Unions and Public Amusements Act 1992'-- 16 omit, insert-- 17 `Art Unions Act 1992'. 18 19 Explanatory note 20 This amendment updates a reference to an Act.

Section 45-- 1 insert-- 2 `(6) In this section-- 3 "TRAWQ communities" means the residents of the area on Thursday 4 Island that-- 5 (a) was formerly known as the Tamwoy community; and 6 (b) consists of the areas known as Tamwoy, Rose Hill, Aplin, 7 Waiben and Quarantine.'. 8 9 Explanatory notes 10 Amendment 1 updates the reference to the Tamwoy community to recognise the new 11 name of the residents of the area as the TRAWQ communities. 12 Amendment 2 removes a spent provision. 13 Amendment 3 is a consequential amendment necessary because of amendment 1. 14 Amendment 4 inserts a definition for section 45. ENTAL TECHNICIANS AND DENTAL 15 ´D PROSTHETISTS ACT 1991 16 Amendments 17 1. Section 55(1), `(other than the by-laws)'-- 18 omit. 19 2. Section 55(2)-- 20 omit, insert-- 21 `(2) The penalty of 17 penalty units mentioned in subsection (1) does not 22 apply for a contravention of a by-law.'. 23
11 Statute Law (Miscellaneous Provisions) SCHEDULE (continued) 1 Explanatory notes 2 Amendment 1 ensures that penalties prescribed for contraventions of the by-laws 3 have effect. 4 Amendment 2 is a consequential amendment to amendment 1 and ensures that the 5 maximum penalty for a breach of a by-law remains at not more than 10 penalty units 6 (for an individual) as provided by section 58(2)(i) of the Act. DUCATION (GENERAL PROVISIONS) ACT 1989 7 ´E Amendments 8 1. Section 61(3), from `, including' to `64(8)'-- 9 omit. 10 2. Section 144(5), from `executive director' to `situated'-- 11 omit, insert-- 12 `chief executive'. 13 14 Explanatory notes 15 Amendment 1 omits a redundant cross-reference. 16 Amendment 2 updates section 144 by changing the current reference to executive 17 director to chief executive. This amendment is necessary because the position of 18 executive director no longer exists.
