2006 A Bill for An Act to amend the Sports Drug Testing Act 2003
s1 4 s5 Sports Drug Testing Amendment Bill 2006 The Parliament of Queensland enacts-- 1 Clause 1 Short title 2 This Act may be cited as the Sports Drug Testing Amendment 3 Act 2006. 4 Clause 2 Act amended 5 This Act amends the Sports Drug Testing Act 2003. 6 Clause 3 Amendment of long title 7 Long title, `enable the Australian Sports Drug Agency to test 8 State competitors'-- 9 omit, insert-- 10 `provide for the testing of State athletes'. 11 Clause 4 Amendment of s 1 (Short title) 12 Section 1, `Drug Testing'-- 13 omit, insert-- 14 `Anti-Doping'. 15 Clause 5 Amendment of s 3 (Objects of Act) 16 (1) Section 3(1)(a), `of State competitors'-- 17 omit, insert-- 18 `and safety of State athletes'. 19 (2) Section 3(2)-- 20 omit, insert-- 21 `(2) The objects are to be achieved mainly by providing for the 22 State to enter into an agreement with the Commonwealth 23 under which anti-doping testing services, and educational 24

s9 6 s 10 Sports Drug Testing Amendment Bill 2006 `(1) This section applies if-- 1 (a) ASADA carries out testing of State athletes under the 2 NAD scheme; and 3 (b) before asking a State athlete who is under 18 years to 4 supply a sample, or before taking a sample from the 5 State athlete, ASADA seeks the consent of the athlete's 6 parent or guardian to the sample being supplied or 7 taken.'. 8 (3) Section 11(2), example-- 9 omit, insert-- 10 11 `Example, for subsection (2), of consent given generally-- 12 Consent given-- 13 (a) at the time the State athlete becomes a member of a State sporting 14 organisation; or 15 (b) at the time the State athlete registers with a sporting organisation 16 to compete in an open age sporting competition.'. s 10 7 s 10 Sports Drug Testing Amendment Bill 2006 Commonwealth Act means the Australian Sports Anti-Doping 1 Authority Act 2006 (Cwlth). 2 NAD scheme means the NAD scheme under the 3 Commonwealth Act. 4 receiving State support-- 5 A person is receiving State support if the person, for taking 6 part or training to take part in sporting activities-- 7 (a) receives funding from the State; or 8 (b) uses facilities provided by the State, or operated or 9 maintained with funding from the State; or 10 (c) is a member of, or is associated with, a State sporting 11 organisation that-- 12 (i) receives funding from the State; or 13 (ii) uses facilities provided by the State, or operated or 14 maintained with funding from the State; or 15 (iii) receives advice or other services from the State. 16 State sporting organisation means a sporting organisation 17 recognised by the agency responsible for the administration of 18 sport in the State as the sporting organisation for a sport in the 19 State.'. 20 (3) Schedule, definition State competitor, `competitor'-- 21 omit, insert-- 22 `athlete'. 23 © State of Queensland 2006
