s1 4 s4 Education Legislation Amendment Bill 2007 The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Education Legislation 4 Amendment Act 2007. 5 Part 2 Amendment of Education 6 (Queensland College of 7 Teachers) Act 2005 8 Clause 2 Act amended in pt 2 9 This part amends the Education (Queensland College of 10 Teachers) Act 2005. 11 Clause 3 Amendment of s 29 (Requirements for renewal--full 12 registration) 13 Section 29(2)(d)-- 14 omit, insert-- 15 `(d) the person has undertaken, during the relevant period of 16 registration, the continuing professional development 17 required for registered teachers under the CPD 18 framework.'. 19 Clause 4 Amendment of s 30 (Development or recognition of CPL 20 framework by college) 21 (1) Section 30, heading, `CPL'-- 22 omit, insert-- 23

s8 6 s9 Education Legislation Amendment Bill 2007 (a) a CPL framework under the pre-amended Act is taken to 1 be a CPD framework; and 2 (b) a reference in an Act or document to continuing 3 professional learning in relation to a CPL framework 4 may, if the context permits, be taken to be a reference to 5 continuing professional development; and 6 (c) a reference in an Act or document to a professional 7 learning program for returning to teaching may, if the 8 context permits, be taken to be a reference to a 9 professional development program. 10 `(2) In subsection (1)-- 11 pre-amended Act means this Act as in force immediately 12 before the commencement of the Education Legislation 13 Amendment Act 2007, part 2.'. 14 Clause 8 Amendment of sch 3 (Dictionary) 15 (1) Schedule 3, definition CPL framework-- 16 omit, insert-- 17 `CPD framework see section 30(1).'. 18 (2) Schedule 3, definition returning to teaching condition, 19 `learning'-- 20 omit, insert-- 21 `development'. 22 Part 3 Amendment of Education 23 (Queensland Studies Authority) 24 Act 2002 25 Clause 9 Act amended in pt 3 26 This part amends the Education (Queensland Studies 27 Authority) Act 2002. 28

 


 

s 10 7 s 11 Education Legislation Amendment Bill 2007 Clause 10 Insertion of new s 10A 1 After section 10-- 2 insert-- 3 `10A Testing functions for common national tests 4 `The authority has, for implementing common national tests, 5 the following functions-- 6 (a) to participate in the development or revision of the tests; 7 (b) to implement procedures for administering the tests by 8 schools or the authority; 9 (c) to mark the tests; 10 (d) to analyse systemic information about the performance 11 of persons who undertake the tests and report the results 12 of the analysis to the Minister, the chief executive, AISQ 13 and QCEC; 14 (e) to give the principal of a school individual results of the 15 school's students who undertake the tests; 16 (f) to give a person who undertakes the tests the person's 17 results in the tests.'. 18 Clause 11 Insertion of new s 19A 19 After section 19-- 20 insert-- 21 `19A Common national tests 22 `(1) If the authority participates in the development or revision of a 23 common national test, the authority must, as soon as 24 practicable after the development or revision, give a notice 25 stating the type of test developed, or the test that has been 26 revised, to-- 27 (a) the Minister; and 28 (b) the governing body of each non-State school. 29

 


 

s 12 8 s 12 Education Legislation Amendment Bill 2007 `(2) If a school administers a common national test, the school's 1 principal must give the authority the test script of each of the 2 school's students who undertakes the test. 3 `(3) This section is subject to section 21.'. 4 Clause 12 Amendment of sch 2 (Dictionary) 5 Schedule 2-- 6 insert-- 7 `common national test means a test in literacy or numeracy 8 specified in a regulation made under the Commonwealth Act. 9 Commonwealth Act means the Schools Assistance (Learning 10 Together--Achievement Through Choice and Opportunity) 11 Act 2004 (Cwlth). 12 implementing, in relation to common national tests, means 13 implementing the tests under a regulation made under the 14 Commonwealth Act. 15 regulation made under the Commonwealth Act means a 16 regulation made under the following provisions of the 17 Commonwealth Act-- 18 (a) for a State school--section 19(4); 19 (b) for a non-State school--section 36(4).'. 20 © State of Queensland 2007
