TOBACCO REGULATIONS


Regulations under the Tobacco Act


  1. Citation

These Regulations may be cited as the Tobacco Regulations. (See back note 1)

  1. Commencement

These Regulations come into operation on the commencement of the Tobacco Act. (See back note 1)

  1. Definition

In these Regulations, unless the contrary intention appears, "marked", in relation to a package, means printed on the package or affixed to it by means of an adhesive label.

  1. Health warning to comply with section 6 of Act

(1) A health warning on a package of cigarettes referred to in section 6 of the Act means –

(a) one of the following statements:

(i) "SMOKING CAUSES LUNG CANCER";

(ii) "SMOKING CAUSES HEART DISEASE";

(iii) "SMOKING DAMAGES YOUR LUNGS";

(iv) "SMOKING REDUCES YOUR FITNESS"; and

(b) the attribution "Health Authority Warning" which shall appear below the statement.

(2) Subject to subregulation (4), the statement referred to in subregulation (1)(a) shall be marked in one line of capital letters of not less than 14 point.

(3) The attribution referred to in subregulation (1)(b) shall be marked in one line of capital and lower case letters that are 50% of the point size of those in which the statement is printed.

(4) The lettering of the statement may be smaller than 14 point size if it is in the largest practicable point size and the lettering of the statement and the attribution together cover at least 15% of each face on which they are marked.

  1. Position and prominence of health warning on cigarette package

(1) The health warning referred to in regulation 4 shall be marked at the base of the front and back of a container.

(2) Where a container does not have front and back faces, the health warning shall be

marked –

(a) in the case of a pouch, tin or cylinder, on each face on which the brand name appears; and

(b) in any other case, on not less than 2 faces.

(3) The health warning –

(a) shall be marked in a colour or colours that will contrast distinctly with the background on which it appears or they appear; and

(b) subject to paragraph (a), may be marked in a colour that appears elsewhere on the container.

  1. Area above health warning on cigarette package

(1) Immediately above a health warning referred to in regulation 4, a space shall be provided that is equal in size to the area of the statement.

(2) A person shall not permit any graphics or inscriptions to be marked in the space referred to in subregulation (1) unless they are part of a trade mark and do not occupy more than 50% of the area of the space.

  1. Health warning required under section 7(a) of Act

(1) A health warning required under section 7(a) of the Act means –

(a) a statement prescribed in regulation 4(1)(a) in one line of capital letters not less than 24 point; and

(b) the attribution prescribed in regulation 4(1)(b) which shall appear below the statement in one line of capital and lower case letters not less than 14 point,

which shall be –

(c) contained within an area not less than 55 millimetres high and 160 millimetres wide; and

(d) marked in black bold Helvetica letters on a white background.

  1. Notice required under section 7(b) of Act

(1) A notice required under section 7(b) of the Act –

(a) shall contain the following words:

(i) "NOTICE" in capital letters not less than 24 point;

(ii) "THE SALE AND SUPPLY OF CIGARETTES AND TOBACCO PRODUCTS TO CHILDREN UNDER 18 YEARS OF AGE IS PROHIBITED" in capital and lower case letters not less than 24 point;

(b) "Maximum penalty: $10,000" in capital and lower case letters not less than 14 point; and

(c) "Sections 8 & 9 NT TOBACCO ACT" in capital letters not less than 14 point,

which shall be –

(d) contained within an area not less than 110 millimetres high and 160 millimetres wide; and

(e) marked in black bold Helvetica letters on a white background.

  1. Notice required under section 8(1) of Act

(1) A notice under section 8(1) of the Act shall contain the following words:

(a) "NOTICE" in capital letters not less than 48 point;

(b) "THE SALE AND SUPPLY OF CIGARETTES AND TOBACCO PRODUCTS TO CHILDREN UNDER 18 YEARS OF AGE IS PROHIBITED" in capital and lower case letters not less than 48 point;

(c) "Maximum penalty: $10,000" in capital and lower case letters not less than 24 point; and

(d) "Sections 8 & 9 NT TOBACCO ACT" in capital letters not less than 24 point,

which shall be –

(e) contained within an area not less than 210 millimetres high and 297 millimetres wide; and

(f) marked in black bold Helvetica letters on a white background.
