PET MEAT REGULATIONS

Regulations under the Pet Meat Act

Part I Preliminary

  1. Citation

These Regulations may be cited as the Pet Meat Regulations.

Part II Administration

  1. Certificate of confiscation, &c.

Where an Inspector exercises a power in pursuance of section 11(d) of the Act, he shall issue a certificate in accordance with Form 1 to the person from whom he takes possession or control of the carcass, flesh or other product derived from an animal.

Part III Licence to slaughter

  1. Application for licence to slaughter

For the purposes of section 14 of the Act:

(a) the prescribed form of an application for a licence to slaughter is Form 2; and

(b) the prescribed fee is $100.

  1. Type of dye

For the purposes of section 17(e) of the Act, the flesh from an animal slaughtered by the holder of a licence to slaughter shall be identified:

(a) by dusting with charcoal;

(b) by staining with a solution of the dye Tartra-zine, being a solution of one part of the dye to 20 parts of water; or

(c) by staining with a solution of the dye Brilliant Blue FCF, being a solution of one part of the dry active dye to 500 parts of water.

  1. Record of operations and returns

(1) For the purposes of section 17(m) of the Act:

(a) the prescribed record of operations shall consist of a book in which details of the species, sex, brand (if any) and weight of animals slaughtered during a day, and the name of the processor to whom the meat is sent, shall be entered daily; and

(b) the prescribed return is Form 3.

(2) The prescribed return under subregulation (1)(b) shall be furnished to the Chief Inspector on or before the fifth day in the month after the month to which the form relates.

  1. Implied slaughtering conditions

Subject to a contrary intention in the licence, the conditions set out in Schedule 2 form part of a licence to slaughter.

Part IV Licence to process

  1. Application for licence to process

For the purposes of section 18 of the Act:

(a) the prescribed form of an application for a licence to process is Form 4; and

(b) the prescribed fee is $100.

  1. Standards for licensed processing places

The prescribed standards for a licensed processing place are those standards set out in Schedule 3.

  1. Records

(1) For the purposes of section 22(f) of the Act:

(a) the prescribed records shall be in accordance with Form 5; and

(b) the prescribed return is Form 6.

(2) The prescribed return under subregulation 1(b) shall be furnished to the Chief Inspector on or before the fifth day in the month after the month to which the form relates.

  1. Implied processing conditions

Subject to a contrary intention in the licence, the conditions set out in Schedule 4 form part of a licence to process.

Part V Licence to store

  1. Application for licence to store

For the purposes of section 24 of the Act:

(a) the prescribed form of an application for a licence to store is Form 7; and

(b) the prescribed fee is $100.

  1. Standards for licensed storing facilities

The prescribed standards for a licensed storing facility, other than a facility which is registered under the Export (Meat) Regulations of the Commonwealth, are those standards set out in Schedule 5.

  1. Records

(1) For the purposes of section 28(f) of the Act:

(a) the prescribed records shall be in accordance with Form 8; and

(b) the prescribed return is Form 9.

(2) The prescribed return under subregulation (1)(b) shall be furnished to the Chief Inspector on or before the fifth day in the month after the month to which the form relates.

  1. Implied storing conditions

Subject to a contrary intention in the licence, the conditions set out in Schedule 6 form part of a licence to store.

14A Regulatory offences

An offence of contravening or failing to comply with regulation 5(2), 9(2) or 13(2) is a regulatory offence.

Part VI Licences

  1. Form of licences

For the purposes of section 31(1)(a) of the Act, the prescribed form for a licence to:

(a) slaughter is Form 10;

(b) process is Form 11; and

(c) store is Form 12.

  1. Application for variation of licence

For the purposes of section 33(1) of the Act:

(a) the prescribed form is Form 13; and

(b) the prescribed fee is $20.

  1. Application for renewal of licence

For the purposes of section 34 of the Act:

(a) the prescribed form is Form 14; and

(b) the prescribed fee is $50.

  1. Application for transfer of licence

For the purposes of section 38(1) of the Act:

(a) the prescribed form is Form 15; and

(b) the prescribed fee is $20.

Part VII Offences

  1. Conditions before transporting meat

For the purposes of section 47 of the Act:

(a) the prescribed form of certificate, where the pet meat is to be transported exclusively within the Territory, is Form 16;

(b) the prescribed form, where the pet meat is to be transported to a destination outside the Territory, is Form 17; and

(c) the prescribed conditions are that the containers used to transport the meat:

(i) have internal surfaces made of smooth material which is easily cleaned;

(ii) are resistant to corrosion;

(iii) are water-proof and dustproof; and

(iv) are fitted with sealable lids or doors.

  1. Notice for institution of proceedings

For the purposes of section 53(2) of the Act, the prescribed form of notice is Form 18.

  1. Commercial quantity of meat

For the purposes of sections 47 and 56 of the Act, 50 kilograms of meat shall be deemed to be a commercial quantity.

CONDITIONS WHICH FORM PART OF A LICENCE TO SLAUGHTER

The holder of a licence to slaughter:

(a) exercising, or purportedly exercising, his powers under this licence shall slaughter an animal in a humane manner;

(b) shall ensure that all utensils, receptacles and appliances -

(i) used during a day's operations are cleaned and disinfected within 60 minutes of the completion of the day's operations; and

(ii) are kept clean when not being used during a day's operations; and

(c) shall ensure that unprocessed pet meat in his possession or under his control is packed in clean impervious sealable containers.

STANDARDS FOR LICENSED PROCESSING PLACES

  1. All buildings and appurtenances which form part of the processing facilities shall be soundly constructed and maintained in good repair.
  2. A room used for and in connection with the processing of pet meat:

(a) shall be enclosed;

(b) shall have internal surfaces constructed of impervious, easily cleaned material resistant to wear and corrosion; and

(c) shall have floors adequately drained by means of impervious drains to a save-all outside the building.

  1. The processing room shall have:

(a) an adequate supply of both hot and cold potable water; and

(b) provision for the cleaning of all appliances.

  1. A doorway opening to the outer air shall have a closely fitting self-closing door or an adequate fly repellant air current curtain.
  2. A processing room shall be provided with hand washing basins and soap, water and paper towels or other approved hand drying equipment shall be supplied at all times.
  3. A table, bench or appliance used in connection with the processing of pet meat shall have a surface of corrosion-resistant metal or other impervious material which is smooth, level and free from cracks.
  4. A cutting board shall have a polyethylene surface.
  5. Waste material shall be placed in containers made of plastic, metal or fibreglass which shall be emptied and cleaned at least once each day or as directed by an Inspector.

Schedule 4

regulation 10

CONDITIONS WHICH FORM PART OF A LICENCE TO PROCESS

The holder of a licence to process shall:

(a) ensure that no animal is within the licensed processing place;

(b) take all reasonable steps to control the incidence of insects or vermin within the licensed processing place;

(c) ensure that all utensils, receptacles and appliances:

(i) used during a day's operations are cleaned and disinfected within 60 minutes of the completion of the day's operations; and

(ii) are kept clean when not being used during a day's operations;

(d) ensure that when unprocessed pet meat is delivered to the licensed processing place it is transferred to a chilling or freezing chamber within 2 hours after its delivery;

(e) ensure that processed pet meat in his possession or under his control is wrapped or packed in clean material or packing;

(f) ensure that all pet meat is identified:

(i) by dusting with charcoal;

(ii) by staining with the dye Tartrazine, being a solution of one part of the dye to 20 parts of water; or

(iii) by staining with the dye Brilliant Blue FCF, being a solution of one part of the dry active dye to 500 parts of water,

on all surfaces where the meat is quartered or cut into portions or by dispersing it through ground or minced pet meat so that it is visible;

(g) ensure that where 10 kilograms or less of pet meat is packed into disposable containers, cartons or individual packs each disposable container, carton or individual pack is prominently and legibly marked in letters at least 8 millimetres high with the words "PET MEAT – NOT FOR HUMAN CONSUMPTION"; and

(h) ensure that where more than 10 kilograms of pet meat is packed into disposable containers, cartons or individual packs each disposable container, carton or individual pack:

(i) is prominently and legibly marked in letters at least 25 millimetres high with the words "PET MEAT – NOT FOR HUMAN CONSUMPTION"; and

(ii) bears a continuous band in distinct yellow colouring, not less than 50 millimetres wide, applied right around the disposable container, carton or individual pack.

Schedule 5

STANDARDS FOR LICENSED STORING FACILITIES

  1. A storage room:

(a) shall be soundly constructed and maintained in good repair to the satisfaction of an Inspector;

(b) shall be enclosed and all floors and other internal surfaces shall be constructed of impervious, easily cleaned material resistant to wear and corrosion; and

(c) shall have adequate chilling or freezing space to the satisfaction of an Inspector.

  1. A doorway opening to the outer air shall have a sealable door with a safety release catch on the inside.

CONDITIONS WHICH FORM PART OF A LICENCE TO STORE

The holder of a licence to store shall:

(a) ensure that no animal is within the licensed storing facility;

(b) take all reasonable steps to control the incidence of insects or vermin within the licensed storing facility;

(c) ensure the licensed storing facility is kept clean;

(d) ensure that processed pet meat in his possession or under his control is wrapped or packed in clean material or packing;

(e) ensure that where 10 kilograms or less of pet meat is received or stored at the licensed storing facility it is packed into disposable containers, cartons or individual packs and each disposable container, carton or individual pack is prominently and legibly marked in letters at least 8 millimetres high with the words "PET MEAT – NOT FOR HUMAN CONSUMPTION";

(ea) ensure that where more than 10 kilograms of pet meat is received or stored at the licensed storing facility it is packed into disposable containers, cartons or individual packs and each disposable container, carton or individual pack:

(i) is prominently and legibly marked in letters at least 25 millimetres high with the words "PET MEAT – NOT FOR HUMAN CONSUMPTION"; and

(ii) bears a continuous band in distinct yellow colouring, not less than 50 millimetres wide, applied right around the disposable container, carton or individual pack; and

(g) ensure that pet meat is kept separate, to the satisfaction of an Inspector, from other food substances.
