NORTHERN TERRITORY UNIVERSITY (STUDENT ASSOCIATION) BY-LAWS
By-laws under the Northern Territory University Act
These By-laws may be cited as the Northern Territory University (Student Association) By-laws. (See back note 1)
(1) As soon as practicable after the commencement of these by-laws, the Registrar shall convene a meeting of the students of the University by posting a notice of the proposed meeting on the notice board adjacent to the lift in the foyer of the Administration Building at the Myilly Point Campus and the notice board in the breezeway adjacent to the entrance to the canteen at the Casuarina Campus.
(2) The notice under clause (1) shall state the time of the meeting (not being earlier than 14 days after the notice is posted), the place at which it is to be held and the substantive motion to be considered at the meeting pursuant to by-law 4.
At the meeting convened under by-law 2 –
(a) all students of the University who are present are entitled to vote;
(b) the Registrar shall preside for the purpose of enabling a student present to be elected to preside in the Registrar's place;
(c) questions arising shall be determined by a majority of the students present and voting and, in the event of an equality of votes, the student presiding shall have a casting vote as well as a substantive vote; and
(d) subject to these By-laws, the students present shall determine the procedures to be followed at the meeting.
The meeting convened under by-law 2 shall consider the following substantive motion (and no other substantive motion except for the election of a student to preside):
"That –
(1) the student body known as the Northern Territory University Student Union formed at a meeting of students of the University on 10 April 1989 is hereby established by that name as the student association of the University for the purposes of section 26 of the Northern Territory University Act;
(2) the constitution of the Northern Territory University Student Union adopted at the meeting, as amended at a further meeting of students of the University held on 31 August 1989, be ratified and adopted as the constitution by which (subject to its being approved by the Council of the University) the Union as hereby established is to be governed; and
(3) the office bearers of the Northern Territory University Student Union at the passing of this motion be confirmed as the office bearers of the Union as hereby established in accordance with the constitution.".
The student association of the University established under section 26 of the Act shall, in August of each year –
(a) present to the Council of the University the association’s estimates of expected income and proposed expenditure for the following academic year; and
(b) propose the amount of the amenities fee to be payable by students for the following academic year.
The Council of the University, having regard to the estimates of the association established under section 26 of the Act presented to it in pursuance of by-law 5(a) and to all other matters appearing to the Council to be relevant, shall either approve the student amenities fee proposed by the association pursuant to
by-law 5(b) or fix that fee for the following academic year at such other amount as, after consultation with representatives of the association, the Council thinks proper.
The student association established under section 26 of the Act shall allow the Internal Auditor of the University to inspect the association's records at any reasonable time the Internal Auditor requests to inspect them.
