MOTOR OMNIBUS REGULATIONS
Regulations under the Motor Vehicles Act
These Regulations may be cited as the Motor Omnibus Regulations.
These Regulations shall commence on 9 September, 1953.
These Regulations (except Regulations 8, 9, 11, 12(3)(b), 37, 81 thereof) shall apply to motor omnibuses the property of the Territory and to the drivers and conductors thereof.
In these Regulations, unless the contrary intention appears:
advertisement in relation to the display of an advertisement on or within an omnibus does not include the name of the omnibus service under which the omnibus is operated or the name of the holder of a service licence or motor omnibus licence.
bus stop means an area of a public street that is marked off by:
(a) a part of the kerb of the public street that is between a traffic sign bearing an arrow and the words "BUS STOP" erected on or near to that kerb and another such traffic sign on the same side of the public street nearest in the direction indicated by that arrow; or
(b) markings on the pavement of the public street, and which markings are adjacent to:
(i) a traffic sign bearing the words "BUS STOP", "BUSES ONLY" or "BUSES EXCEPTED"; or
(ii) the words "BUS STOP" marked on that pavement.
conductor means a conductor of an omnibus and includes a driver of an omnibus on which no conductor is employed.
conductor's licence means a conductor's licence granted under these Regulations.
footpath means the path or place between the kerb and property lines adjoining a public street set apart for the exclusive use of pedestrians.
licensee means a licensee under a service licence.
medical testing officer means an officer appointed under the Act to be a medical testing officer.
official traffic sign means any notice, sign or other device marked, placed or erected on or at the side of a public street by authority of the Minister for the purpose of guiding, directing, regulating or warning motor vehicles or traffic.
omnibus means a motor omnibus.
omnibus service means a motor omnibus passenger service.
parking means the standing or waiting on a public street of a motor vehicle, whether occupied or not, when not actually engaged in picking up or setting down passengers or goods, or when not required to stop in obedience to official traffic signs or signals by a member of the Police Force and park or parked has a corresponding meaning.
parking area means an area set aside for the parking of vehicles and indicated by an official traffic sign.
registration means registration under the Act.
roadway means that part of a public street open to, or used by, vehicular traffic, but does not include a footpath.
service licence means a licence to conduct an omnibus service.
testing officer means an officer appointed under the Act to be a testing officer.
Part II Motor
omnibus passenger service
(1) The licensee of an omnibus service shall furnish for sale or free distribution to the public every time-table specified in the service licence.
(2) The charge for a copy of any such time-table shall not exceed 5 cents.
The Registrar may, subject to the Act, grant to the owner of an omnibus:
(a) a permit for the omnibus to follow for such period as is stated in the permit, a route other than that to be followed in pursuance of the service licence; or
(b) a permit to vary the time-table to be observed by the omnibus for such period as is specified in the permit.
Any licensee who, without lawful excuse, causes or permits an omnibus engaged in the omnibus service to follow a route other than the route specified in the service licence, or to observe a time-table other than that specified in the service licence, shall be guilty of an offence.
Any licensee who, without reasonable excuse, withdraws any omnibus from a route specified in the service licence so as to interfere with the time-table specified in the licence for that route shall be guilty of an offence.
(1) A licensee shall not knowingly allow an omnibus on his service to be altered in any material particular without first obtaining permission of the Registrar.
(2) In the absence of proof to the contrary, any such alteration shall be deemed to have been made with the knowledge of the licensee.
(1) Subject to the approval of the Registrar, the licensee of an omnibus service may make such arrangements with respect to:
(a) the collection of fares from passengers and persons who intend to travel on an omnibus of the omnibus service;
(b) the issue of tickets to passengers or persons referred to in paragraph (a);
(c) the granting of concession fares to specified classes of passengers or persons referred to in paragraph (a); or
(d) the circumstances in which no fare shall be payable by passengers and persons referred to in paragraph (a),
as he thinks fit.
(2) Where a licensee requires a conductor of an omnibus to issue tickets to passengers on the omnibus, the conductor shall, other than in circumstances referred to in subregulation (1)(d), issue to each passenger who pays the fare payable a ticket, in accordance with subregulation (3), in acknowledgement of the payment of the fare.
(3) Every ticket issued to a passenger of an omnibus in acknowledgement of the payment of a fare shall show thereon:
(a) the name of the licensee;
(b) the route or section covered or to be covered; and
(c) the fare payable,
and shall be numbered consecutively.
(1) Subject to regulation 12(1)(c) and (d), a conductor shall demand from every passenger the fare specified in the service licence for the route or section of the route over which the passenger intends to travel or has travelled, as the case may be.
(2) Any conductor who knowingly demands from any passenger more or less than the fare, if any, payable by the passenger shall be guilty of an offence.
A conductor shall, as far as practicable, give to any person, upon request, information as to any matter concerning the route, fares and time-table of the omnibus.
A licensee or the holder of a motor omnibus licence:
(a) shall not display or cause or permit to be displayed any advertisement:
(i) on the outside of the front of any omnibus; or
(ii) on the outside of any window or glass panel of any omnibus;
(b) shall not display or cause or permit to be displayed on the outside of any omnibus any advertisement:
(i) which is of such dimensions or character as to cause danger or inconvenience to any person;
(ii) which is, or part of which is, of glass, celluloid, xylonite or similar material, or reflective material or reflective paint; or
(iii) in such a manner as to conceal, obliterate or be less than 150 mm from any writing or number required by the Act or these Regulations to be placed on the outside of the omnibus; and
(c) shall ensure that any advertisement displayed on the outside of any omnibus is fixed in such a manner that it cannot become loose to the risk or danger to any person.
A licensee or the holder of a motor omnibus licence:
(a) shall not display or cause or permit to be displayed within any omnibus any advertisement which is of such dimensions or character as to cause inconvenience to passengers or which is of glass;
(b) shall not display any advertisement on any window or glass partition in any omnibus;
(c) shall not display any advertisement within any omnibus so as to conceal or obliterate any writing or number plate required by the Act or these Regulations to be placed within the omnibus;
(d) shall ensure that any advertisement on enamelware, ironware or tinplate displayed within an omnibus is fixed in such a manner that it cannot become loose to the risk or danger of any passenger;
(e) shall not hasp, or cause or permit to be hasped any advertisement on the woodwork, sides or roof of any omnibus; and
(f) shall cause every advertisement within any omnibus to be held in a suitable frame which is without glass and so constructed as to be readily opened and closed for the insertion or removal of advertisements.
(1) Where any omnibus breaks down or the driver thereof is unable to cause the omnibus to complete the journey in accordance with the time-table specified in the service licence, the driver shall forthwith communicate with the licensee.
(2) In any such case, the licensee shall provide another registered omnibus (if available) to complete the journey.
Part III Drivers and conductors
Division 1 Licensing of drivers
No person shall drive an omnibus unless he holds a licence which specifies that he is licensed to drive that class of motor vehicle.
An applicant for a licence to drive an omnibus shall prove to the satisfaction of the Registrar that he is:
(a) a person of good character;
(b) a fit and proper person to hold the licence; and
(c) able to read and write the English language.
Before the grant of a licence to drive an omnibus a certificate of fitness and a certificate of competency shall be given by a testing officer and the applicant shall answer in writing the questions required by the Registrar to be answered and shall sign his name thereto in the presence of the Registrar, Deputy Registrar or a Commissioner for Declarations.
An applicant for a licence to drive an omnibus shall submit to the Registrar a certificate of character signed by 2 persons of good repute approved by the Registrar.
(1) Every application for a licence or the renewal of a licence as a driver of an omnibus shall be accompanied by a medical certificate given by a medical testing officer.
(2) If at any time it appears to the Registrar that any person who is licensed as a driver of an omnibus is, by reason of physical infirmity, or for other sufficient physical cause, unfit to be so licensed, the Registrar may require that person forthwith to submit himself for medical examination to a medical testing officer.
Division 2 Licensing of conductors
(1) A person shall not act as a conductor unless he holds a conductor's licence.
(2) The owner of an omnibus shall, before employing any person as a conductor, satisfy himself that that person holds a conductor's licence.
An applicant for a conductor's licence shall prove to the satisfaction of the Registrar that he is:
(a) not less than the age of 16 years;
(b) a person of good character;
(c) a fit and proper person to hold a conductor's licence; and
(d) able to read and write the English language.
An applicant for a conductor's licence shall submit to the Registrar a certificate of character signed by 2 persons of good repute approved by the Registrar.
The Registrar may grant to an applicant, who complies with the provisions of regulations 24 and 25, a conductor's licence in accordance with the form in Schedule 1 and may renew the licence from time to time.
(1) A conductor's licence shall, unless sooner cancelled or suspended, continue in force for a period of 12 months from the date of the grant or renewal thereof.
(2) The renewal of a conductor's licence shall commence on the day immediately following the date of which the licence or previous renewal thereof, as the case may be, expired.
The Registrar may cancel or suspend, for such period as he thinks fit, the licence of any conductor:
(a) upon proof to his satisfaction of the misconduct of the conductor in the course of his duties; or
(b) upon the conviction of the conductor of any offence which seriously reflects upon his character as a fit and proper person to hold a conductor's licence.
(1) Any conductor who, when required by the Registrar, or by any officer, inspector, or by a member of the Police Force, acting in the execution of his duty, to produce his conductor's licence, fails to do so, shall be guilty of an offence unless he has a reasonable excuse and within 3 days, produces his licence at the office of the Registrar, or such Police Station as may be directed by the Registrar, officer, inspector or member.
(2) Any conductor who, when required by the Registrar or an officer, inspector, or a member of the Police Force acting in the execution of his duty, to state his name and place of abode, refuses to do so or states a false name or place of abode shall be guilty of an offence.
A conductor shall, when requested so to do by the Registrar, produce his licence for suspension or cancellation.
Division 3 Conduct, &c., of drivers and conductors
(1) When any omnibus has stopped for the purpose of taking up or setting down passengers, the driver shall not re-start the omnibus until directed to do so by the conductor (if any) who shall communicate such direction by means of a whistle or some other signal approved by the Registrar.
(2) The conductor or any other person shall not give any such signal unless and until the omnibus may be re-started without danger to the life or limb of any person.
When any passenger or intending passenger is entering or leaving an omnibus, the driver or conductor of the omnibus shall not negligently or wilfully start or cause the vehicle to start before the passenger has entered the vehicle or has alighted therefrom, as the case may be.
(1) Subject to subregulation (2), where the driver or conductor of an omnibus:
(a) is signalled by an intending passenger at a bus stop specified in the service licence in respect of the omnibus; or
(b) receives an indication from a passenger in or upon the omnibus that the passenger wishes to alight from that omnibus,
the driver or conductor shall stop that omnibus or cause it to stop close to and parallel with the footpath at the bus stop:
(c) at which the intending passenger so signalled; or
(d) next after receiving the indication from the passenger that he wished to alight from that omnibus,
and shall there allow:
(e) that intending passenger to enter that omnibus; or
(f) that passenger to alight from that omnibus,
as the case may be.
(2) Subject to subregulation (3), where it is impracticable for the driver or conductor of an omnibus, due to:
(a) road works being carried out;
(b) parked or stationary vehicles; or
(c) an obstruction,
to stop the omnibus or cause it to stop in accordance with subregulation (1) at a bus stop, the driver or conductor of that omnibus may, where it is safe and reasonable to do so in all the circumstances, stop that omnibus or cause it to stop at a place adjacent, as near as practicable, to the bus stop.
(3) The driver or conductor of an omnibus shall not, in pursuance of subregulation (2), stop the omnibus or cause it to stop at a place other than a bus stop without due regard to:
(a) the safety of passengers entering or alighting from that omnibus; and
(b) avoiding, where practicable, obstruction to other traffic,
and, where so stopping the omnibus, shall not allow it to stand longer than for the period required to pick up or set down passengers.
The driver of an omnibus shall not, during any journey, cause or permit any person to occupy any portion of the driver's seat, or to be upon any portion of the omnibus on the right hand side of the driver's seat and abreast thereof, or upon any portion of the omnibus in front of the driver's seat.
The driver or a conductor of an omnibus shall not:
(a) cause or permit any passenger to be carried outside the omnibus or upon any step or stairway thereof or any portion thereof other than that set aside for passengers;
(b) wilfully deceive or refuse to inform any passenger or intending passenger as to the destination of the omnibus or the route by which it will proceed to such destination; or
(c) suffer or permit any passenger to smoke in or upon the omnibus except in that portion thereof (if any) which is set apart for the purpose.
The driver of an omnibus shall:
(a) start the omnibus from one of the places specified in the service licence for the route upon which the omnibus is authorized to be used;
(b) keep to the route specified in the service licence; and
(c) complete the journey and the parts thereof respectively in the times specified in the service licence for the route upon which the omnibus is authorized to be used.
The conductor of an omnibus shall not cause or permit any person to bring or place thereon any animal, other than a guide dog being used by a blind person.
Where a licensee requires a conductor of an omnibus to issue tickets to passengers on the omnibus, the conductor shall not moisten his fingers with saliva before issuing tickets.
The driver or conductor of an omnibus shall not:
(a) smoke whilst the vehicle is conveying any passengers;
(b) cause annoyance to any person by importuning that person or any other person to become a passenger in the omnibus;
(c) leave the omnibus to tout for passengers; or
(d) endeavour to attract notice by whistling, shouting or calling.
The driver and conductor of an omnibus shall, whilst on duty:
(a) be clean and tidy and wear clean and respectable clothes; and
(b) conduct themselves in an orderly manner and with civility and propriety towards every passenger or intending passenger.
The driver and conductor of an omnibus shall, whilst on duty, have a copy of these Regulations ready for production, and, at the request of any member of the Police Force or an officer or inspector, acting in the execution of his duty, produce the copy for inspection.
The driver of an omnibus shall not upon any public street:
(a) permit any unlicensed person to act as the driver of the omnibus; or
(b) without the consent of the owner of the vehicle, permit any person to act in his stead as the driver of the omnibus.
(1) Subject to subregulation (2), the driver of an omnibus upon a public street or in a public place shall remain on the driving seat of the omnibus.
(2) The driver of an omnibus referred to in subregulation (1) may leave the driving seat of the omnibus where he has taken precautions against that omnibus being started or moved in his absence and such absence:
(a) is for the purpose of being employed in or about that omnibus; or
(b) is with the prior approval of that driver's employer.
(1) A conductor of an omnibus shall not knowingly cause or permit to be carried in the omnibus:
(a) any person suffering from an infectious or contagious disease or illness;
(b) any person who is drunk or dirty, or so attired as to cause annoyance to any other passenger, or to be likely to soil or damage the omnibus or the apparel of any other passenger; or
(c) any person who is noisy or violent or misbehaving or disturbing the public peace.
(2) It shall not be an offence to convey a person referred to in paragraph (c) of subregulation (1) to a Police Station.
The conductor of an omnibus shall not permit any person to place or carry thereon any substance of an offensive character or of such dimensions as to inconvenience any passenger, or any substance which may soil or damage the omnibus or the apparel of any passenger.
If the breach or non-observance of any of these Regulations is attended with danger or annoyance to the public or hindrance to any omnibus, the conductor or driver of the omnibus may summarily interfere to obviate or remove or stop the danger, annoyance or hindrance.
Part
IV Offences by passengers and other persons
(1) Every passenger on an omnibus shall pay the fare payable by him either in cash or by concession or other card or ticket purchased or obtained from the licensee or his agent or servant.
(2) Any person who, in respect of any journey on an omnibus:
(a) refuses or fails to pay the fare payable by him when demanded by the conductor;
(b) avoids or attempts to avoid payment of any fare payable by him;
(c) having paid his fare for travelling over a certain section, knowingly proceeds in the omnibus beyond the limits of that section and does not pay the fare payable in respect of the additional distance,
shall be guilty of an offence.
(3) For the purposes of this regulation, one child under the age of 5 years carried on the lap of a passenger shall not be deemed to be a passenger.
(1) Where a conductor of an omnibus issues tickets to passengers on the omnibus, a passenger on the omnibus shall, upon demand by the conductor, or by any other person authorized by the licensee, or by any member of the Police Force, or any officer, acting in the execution of his duty, exhibit or deliver the ticket issued to him by the conductor for the journey or section of the journey for which the passenger has paid.
(2) If the ticket is not produced when so demanded, the passenger shall, upon demand by the conductor, pay the fare payable for the journey upon which the passenger is then proceeding from the place at which the passenger entered the omnibus.
(1) A passenger on an omnibus shall not tender to the conductor, in payment of his fare, or as evidence that his fare has been paid, any ticket that is rolled up, defaced or illegible, or in such a condition that it cannot be easily read at sight or any ticket that has been divided or from which any parts have been cut or taken off.
(2) Any such ticket so tendered shall not be accepted by the conductor and the passenger tendering the ticket shall be deemed not to have paid his fare, and shall, upon demand by the conductor, pay the fare payable for the journey upon which the passenger is then proceeding.
(1) Subject to subregulation (2), except in the course of his duty under the Act, a person, other than a passenger or intending passenger, shall not enter or go upon an omnibus.
(2) A passenger or intending passenger shall not enter or go upon an omnibus which is unmanned by a driver or conductor except where the driver or conductor of the omnibus has given express permission to the passenger or intending passenger to enter or go upon the omnibus during the absence of that driver or conductor.
A person shall not expectorate upon the floor or any other part of an omnibus.
A passenger upon an omnibus shall not stand upon, or cause or permit any child who is travelling with him to stand upon, the seat of an omnibus.
A person shall not board or alight from or attempt to board or alight from an omnibus while it is in motion.
A person shall not take into or upon any omnibus except into or upon such parts thereof as are provided for the purpose, any luggage other than articles which may conveniently be carried in the hand, and which will not, in the opinion of the conductor, interfere with the comfort of other passengers.
A person while travelling in or upon an omnibus shall not solicit alms, play or perform upon any musical instrument, distribute handbills or advertisements or offer any article for sale.
A person shall not smoke in or upon any omnibus or any portion thereof where smoking is prohibited as indicated by a notice displayed in or upon the omnibus.
(1) A person who, in the opinion of the conductor, is in a state of intoxication shall not be allowed to enter or go upon or remain in or upon an omnibus.
(2) Any such person who enters or goes upon or is found in or upon an omnibus shall, upon being requested by the conductor so to do, leave the omnibus, and his fare (if paid) shall be forfeited.
(3) The conductor may remove or cause to be removed any such person who, upon being requested so to do, does not forthwith leave the omnibus.
(1) Any person who, upon any omnibus, drinks any intoxicating liquor shall be guilty of an offence.
(2) Any such person shall, upon being requested by the conductor so to do, leave the omnibus, and his fare (if paid) shall be forfeited.
(3) The conductor may remove or cause to be removed any such person who, upon being requested so to do, does not forthwith leave the omnibus.
(1) A person:
(a) whose dress, clothing or luggage is, in the opinion of the conductor, likely to soil or injure the seats or linings of any omnibus, or the dress or clothing of any passenger; or
(b) who, in the opinion of the conductor, is likely to be, for any reason, offensive to other passengers,
shall not be entitled to enter or go upon or remain in or upon any omnibus.
(2) The conductor may, with such assistance as he requests, prevent any such person from entering or going upon the omnibus.
(3) Any such person who enters or goes upon or is found in or upon an omnibus shall, upon the request of the conductor, leave the omnibus, and his fare (if paid) shall be forfeited.
(4) The conductor may remove or cause to be removed any such person who, upon being requested so to do, does not forthwith leave the omnibus.
A person, not being an officer acting in the execution of his duty, shall not enter the driver's compartment or occupy a seat by the side of the driver of any omnibus or ride on the omnibus in front of the driver's seat.
A passenger shall not ride on the step or on any portion of an omnibus other than that provided for the use of passengers.
A person shall not bring into or upon any omnibus:
(a) any loaded firearms, cinema films, or sheet glass;
(b) any paint or oil which is not carried in properly sealed containers;
(c) anything which projects beyond the omnibus; or
(d) anything which is, in the opinion of the conductor, liable to damage the omnibus or cause injury or inconvenience to, or damage to the property of, any passenger.
(1) A person shall not use profane, obscene, insulting or offensive language, or commit any nuisance in or upon any omnibus or wilfully interfere with the comfort of any passenger in or upon the omnibus.
(2) Any person who, in the opinion of the conductor, has committed a breach of subregulation (1) shall, upon the request of the conductor, leave the omnibus and his fare (if paid) shall be forfeited.
(3) The conductor may remove or cause to be removed any such person who, upon being requested so to do, does not forthwith leave the omnibus.
A person shall not:
(a) deface any notice on any part of an omnibus;
(b) obstruct any person employed on an omnibus in the performance of his duty;
(c) behave in a violent or offensive manner to the annoyance of any other person in or upon an omnibus; or
(d) refuse to leave the platform or steps of any omnibus when lawfully requested by the conductor to do so.
A person shall not interfere with, remove or alter any part of an omnibus or do or cause to be done anything which is likely to obstruct any omnibus or to endanger the life or limb of any person.
Any person who:
(a) damages any omnibus;
(b) removes, interferes with or destroys any fastening in or upon any omnibus;
(c) removes, defaces or destroys any lamp, number, fitting, printed notice or advertisement in or upon any omnibus;
(d) breaks or scratches any window or wood or ironwork in or upon any omnibus,
shall be guilty of an offence and, in addition to any penalty imposed in respect of the offence, shall be liable to pay the cost of making good the damage done or replacing the thing removed or destroyed.
A person shall not bring or cause to be brought into or upon an omnibus any dog or other animal, other than a guide dog where the person is blind.
No person shall ride in or upon an omnibus while suffering from an infectious or contagious disease or illness, or after having so recently suffered from such disease or illness as to be likely to be a source of infection of contagion.
(1) A person, upon being informed by the conductor that the omnibus has a full complement of passengers or is overcrowded, shall not board the omnibus.
(2) Any person who boards an omnibus, and, before paying his fare, is told by the conductor that the omnibus has a full complement of passengers or is overcrowded, shall, upon being requested by the conductor so to do, forthwith leave the omnibus.
Any unlicensed person acting as the driver or conductor of an omnibus shall be subject to these Regulations and be liable for any breach thereof in like manner as if he were a licensed driver or conductor.
Where any person driving or conducting an omnibus is arrested, any member of the Police Force may take charge of the vehicle, and place it in a place of safety until claimed by the owner.
In the event of an accident occurring in connection with an omnibus, the driver and conductor, or the driver, as the case may be, shall forthwith give notice of the accident to the licensee of the service who shall, within 7 days of the date of the accident, cause to be furnished to the Registrar a report of the accident, containing such particulars as are required by the Registrar.
The driver or owner of an omnibus shall not cause or permit the omnibus to be used for an illegal purpose.
Any member of the Police Force or any driver or conductor of an omnibus may remove:
(a) any passenger from an omnibus which, in the opinion of the member, driver or conductor, is overcrowded; or
(b) any person riding upon the step or any part of an omnibus other than that provided for the accommodation of passengers.
(1) Any driver or conductor of an omnibus may require any person reasonably suspected of having committed an offence against these Regulations to give his full name and place of abode.
(2) Any person who, upon being so required, refuses or fails to give his full name or place of abode shall be guilty of an offence.
(3) Any driver or conductor, while employed upon an omnibus, may apprehend any such person who refuses or fails to give his full name or place of abode, and may detain him until he can be delivered into the custody of a member of the Police Force, to be dealt with according to law.
A licensee under a licence to ply for hire in respect of an omnibus shall:
(a) keep a record of the full name and place of abode of each person who has driven or conducted the omnibus and the dates upon which that person drove or conducted the omnibus; and
(b) at the request of the Registrar, or of a member of the Police Force, or of an officer, acting in the execution of his duty, produce the record for the inspection of the Registrar, member or officer:
Provided that it shall not be necessary for the licensee to produce the record of any driver or conductor for a period exceeding 3 months preceding the date on which the request is made.
A licensee under a licence to ply for hire in respect of an omnibus shall, before permitting or employing any person to act as the driver or conductor of the vehicle, produce to that person, if so required by him the certificate of registration or licence in respect thereof.
A conductor may require any child who is travelling at concession or reduced fare or without payment of fare and is occupying a seat in the omnibus to surrender the seat to an adult passenger and, upon being so required, the child shall forthwith surrender the seat.
(1) The Registrar may, by notice in writing, require any licensee under a licence to ply for hire in respect of an omnibus or under a licence to conduct a motor omnibus passenger service to produce at the office of the Registrar, within such time as is specified in the notice, his licence or licences.
(2) Any licensee who, without reasonable excuse, fails, after receipt of a notice under subregulation (1), to produce his licence or licences at the office of the Registrar within the time specified in the notice shall be guilty of an offence.
(1) An omnibus shall not, unless expressly authorized by the Registrar, ply for hire on any public street, or portion thereof, upon which it is not licensed to ply.
(2) The owner and driver of any omnibus which plies for hire in contravention of subregulation (1) shall be guilty of an offence.
(1) While an omnibus is being used as a school bus, it shall carry, prominently displayed at the front and at the rear of the bus, a rectangular sign not less than 1,500 millimetres long and not less than 250 millimetres wide, carrying the words "SCHOOL BUS" on a yellow background in bold-faced black letters not less than 200 millimetres high.
(2) A sign displayed in pursuance of subregulation (1) shall be clearly legible in normal conditions from a distance of 30 metres.
(3) The driver of an omnibus shall ensure that a sign in accordance with this regulation:
(a) is displayed at all times while the bus is being used as a school bus; and
(b) is not displayed except while the bus is being so used.
(4) For the purposes of this regulation, an omnibus is being used as a school bus while it is engaged principally in carrying children to or from school and the route that it is taking begins or ends at a school.
Subject to regulation 83, the owner of an omnibus shall cause to be securely fixed in a conspicuous place within the vehicle the metal plate supplied by the Registrar showing the letters and figures of the number-plates issued in connection with the registration of the vehicle.
(1) Where, in respect of an omnibus which is registered in some place outside the Territory, a licence is granted to ply for hire in the Territory, the Registrar shall issue to the person in whose name the omnibus is registered in such place, a label having thereon particulars of the omnibus, the duration of the licence and any other matters which the Registrar thinks proper to insert.
(2) The label shall, during the currency of the licence, be affixed and kept affixed by such person on the inside or back of the main part of the windscreen of the omnibus in such a position that the centre of the label is not more than 150 mm from the bottom left-hand or near side corner of the windscreen, and so that the front of the label faces towards the front of the vehicle.
A person riding a bicycle shall not hold on to any part of an omnibus.
The driver and the owner of an omnibus shall take adequate steps to prevent oil and grease dropping from the machinery to the roadway.
The places or parts of the public streets indicated by official signs shall be bus stops for the exclusive use (subject to sections 26A and 38K of the Commercial Passenger (Road) Transport Act) of motor omnibuses for the purpose of picking up or setting down passengers.
Any person who commits, or knowingly aids, abets, counsels, procures or assists any person to commit, a breach of any of these Regulations shall be guilty of an offence.
Maximum penalty: $50.
An offence of committing, or knowing, aiding, abetting, counselling, procuring or assisting any person to commit, a breach of regulation 18, 23, 30, 35, 36, 40(a), 42, 57, 59(1) or (2), 61, 63, 73, 77, 78, 81A, 82, 83(2) or 84 is a regulatory offence.
Subject to section 87A, no person shall be deemed to be guilty of a breach of any of these Regulations if he proves to the satisfaction of the Court hearing the case that the occurrence which is the subject of the case was the result of accident, or could not have been avoided by any reasonable efforts on his part.
