MARINE (LOAD LINE) REGULATIONS

Regulations under the Marine Act

Part I Introductory

  1. Citation

These Regulations may be cited as the Marine (Load Line) Regulations.

  1. Commencement

These Regulations shall come into operation on a date to be fixed by the Minister by notice in the Gazette.

  1. Interpretation

In these Regulations, unless the contrary intention appears:

Code means the Uniform Code and includes appendices thereto.

section, clause and subclause mean section, clause and subclause of the Code.

vessel means a vessel to which Part IV, Division 3 of the Act applies.

Part II Load line requirements

  1. Application of Code

Subject to these Regulations, section 7 extends and applies to all vessels.

  1. Construction of Code

In construing section 7:

(a) the definitions contained in section 1 and that section shall be read subject to the Act and these Regulations;

(b) the reference to the Authority in subclause 3.9 shall be read as a reference to the Minister;

(c) all other references to the Authority shall be read and construed as references to the Director; and

(d) references to survey authority shall be read as references to a classification society appointed as a surveyor.

  1. Forms

(1) The prescribed form of a load line certificate is that set out in Form LL1 in the Schedule.

(2) The prescribed form of a load line exemption certificate is that set out in Form LL2 in the Schedule.

  1. Cancellation of load line certificate

Where a vessel's load line certificate has been cancelled:

(a) the certificate shall cease to have effect from the time that the Director serves on the owner, master or agent of the owner of the vessel, notice in writing of the cancellation;

(b) the Director may, when serving notice of the cancellation of the certificate, require the owner, master or agent of the owner of the vessel to deliver up the certificate to him, and may detain the vessel until the cancelled certificate is delivered up to him.

  1. Overloading

For the purposes of section 94(1) of the Act, the prescribed amount in respect of each 25 mm or part thereof by which the vessel is overloaded is 5 penalty units.

  1. Fees

Fees for survey and issue of a load line certificate or load line exemption certificate shall be as from time to time determined by the Minister by notice in the Gazette.
