MARINE (CREW ACCOMMODATION) REGULATIONS
Regulations under the Marine Act
These Regulations may be cited as the Marine (Crew Accommodation) Regulations.
These Regulations shall come into operation on a date to be fixed by the Minister by notice in the Gazette.
In these Regulations, unless the contrary intention appears:
Code means the Uniform Code and includes appendices thereto.
section, clause and subclause mean section, clause and subclause of the Code.
vessel means a vessel 25 metres or over but less than 55 metres in length, other than a vessel that is:
(a) an air-cushioned vehicle;
(b) a pleasure craft;
(c) a commercial vessel that is proceeding on an interstate or overseas voyage;
(d) a fishing vessel that is proceeding on an overseas voyage;
(e) an off-shore industry mobile unit; or
(f) an off-shore industry vessel in respect of which a declaration under section 8A(5) of the Navigation Act is in force.
Part
II Requirements for crew accommodation
Subject to these Regulations, section 6 extends and applies to all vessels.
In construing section 6:
(a) the definitions contained in section 1 shall be read subject to the Act and these Regulations;
(b) the reference to the Authority in subclauses 3.3 and 3.4 shall be read as a reference to the Director.
(1) Where:
(a) a vessel is in the course of being built, chartered or purchased; and
(b) the person to whose order the vessel is being so built, chartered or purchased intends that the vessel shall be a vessel to which these Regulations will apply,
the person mentioned in paragraph (b) shall submit to the Director for approval a plan of the vessel showing clearly both the arrangement and position in the vessel of the crew accommodation.
(2) Before:
(a) construction of crew accommodation in a new vessel; or
(b) substantial alteration or reconstruction of crew accommodation in an existing vessel,
is commenced, detailed plans of the crew accommodation of the vessel shall be submitted to the Director for approval.
Part
III Inspection of crew accommodation
The master of a vessel, being a vessel less than 55 metres in length, shall inspect the crew accommodation of the vessel at intervals of not more than 30 days and on each inspection shall be accompanied by another member of the crew.
Penalty: 50 penalty units.
The Director may, at any time, request a surveyor to carry out an inspection of the crew accommodation in a vessel and make a report in writing to him.
