Regulations under the Electrical Workers and Contractors Act 1978
These Regulations may be cited as the Electrical Workers and Contractors Regulations 1984.
These Regulations shall come into operation on the commencement of the Electrical Workers and Contractors Amendment Act 1983.
The Electrical Workers and Contractors Regulations, being Regulations No. 38 of 1978, are repealed.
In these Regulations, unless the contrary intention appears:
College means a registered training organisation registered under the Training and Skills Development Act 2016 to deliver electrotechnology training packages.
tradesman's certificate means:
(a) a tradesman's certificate issued under the Tradesmen's Rights Regulation Act 1946 of the Commonwealth; or
(b) another document issued under that Act which attests that the holder of the document would be eligible to hold a tradesmen's certificate provided certain residency requirements were met or the holder was no longer a member of the Defence Forces of Australia.
Part
II Qualifications for electrical workers' licences
The qualifications required for the granting of an application for an electrical worker's licence endorsed as electrical mechanic grade A are that the applicant:
(a) was, immediately before the commencement of the Electrical Workers and Contractors Amendment Act 1983, the holder of an electrical mechanic's licence grade A under the Electrical Workers and Contractors Act 1978 as then in force;
(b) has:
(i) completed an apprenticeship to the trade of electrical mechanics or electrical fitter/mechanic under the Training and Skills Development Act 2016;
(ii) satisfactorily completed the course of instruction for electrical fitter/mechanic apprentices at a College; and
(iii) during his apprenticeship, obtained at least 12 months experience in the trade work of an electrical mechanic;
(c) has, outside the Territory:
(i) completed an apprenticeship to the trade of electrical mechanic or electrical fitter/ mechanic;
(ii) satisfactorily completed a course of instruction for electrical mechanic or electrical fitter/mechanic apprentices; and
(iii) within the period of 12 months immediately before the date of his application, been the holder of a licence or certificate specified in Schedule 1;
(d) has, in the opinion of the Board, sufficient knowledge of the trade of electrical mechanic, evidenced, where the Board thinks fit, by an examination conducted or approved by the Board, and:
(i) he is the holder of an electrical worker's licence endorsed as electrical fitter grade A and has obtained at least 12 months experience in the trade work of electrical mechanic;
(ii) he is the holder of an electrical worker's licence endorsed as electrical mechanic grade B and, after the granting of the licence, has obtained at least 12 months experience in the trade work of electrical mechanic;
(iii) he has completed an apprenticeship to the trade of electrical mechanic but has failed to complete satisfactorily the course of instruction for electrical fitter/mechanic apprentices referred to in paragraph (b); or
(iv) he is the holder of a tradesman's certifi-cate endorsed as electrical mechanic; or
(e) has:
(i) in the opinion of the Board, sufficient knowledge of the trade of electrical mechanic, evidenced, where the Board thinks fit, by an examination conducted or approved by the Board; and
(ii) within the period of 12 months immediately before the date of his application, been the holder of a licence or certificate specified in Schedule 1 and it was granted based upon an examination or practical experience and training of the applicant and that experience and training is, in the opinion of the Board, at least equivalent to the experience and training which an electrical fitter/mechanic apprentice would obtain during his apprenticeship in the Territory.
The qualifications required for the granting of an application for an electrical worker's licence endorsed as electrical fitter grade A are that the applicant:
(a) was, immediately before the commencement of the Electrical Workers and Contractors Amendment Act 1983, the holder of an electrical mechanic's licence grade R endorsed for electrical fitting without restriction, under the Electrical Workers and Contractors Act 1978 as then in force;
(b) has:
(i) completed an apprenticeship to the trade of electrical fitter or fitter/mechanic under the Training and Skills Development Act 2016;
(ii) satisfactorily completed the course of instruction for electrical fitter/mechanic apprentices at a College; and
(iii) during his apprenticeship, has obtained at least 12 months experience in the trade work of electrical fitter;
(c) has, outside the Territory:
(i) completed an apprenticeship to the trade of electrical fitter or electrical fitter/ mechanic;
(ii) satisfactorily completed a course of instruction for electrical fitter apprentices; and
(iii) within the period of 12 months immediately before the date of his application, been the holder of a licence or certificate specified in Schedule 2;
(d) has, in the opinion of the Board, sufficient knowledge of the trade of electrical mechanic, evidenced, where the Board thinks fit, by an examination conducted or approved by the Board, and he:
(i) is the holder of an electrical worker's licence endorsed as electrical mechanic grade A and has at least 12 months experience in the trade work of electrical fitter;
(ii) is the holder of an electrical worker's licence endorsed as electrical fitter grade B and, after the granting of the licence, has obtained at least 12 months experience in the trade work of electrical fitter;
(iii) has completed an apprenticeship to the trade of electrical fitter but has failed to complete satisfactorily the course of instruction for electrical fitter/mechanic apprentices at a College; or
(iv) is the holder of a tradesman's certificate endorsed as electrical fitter; or
(e) has sufficient knowledge of the trade of electrical fitter, evidenced, where the Board thinks fit, by an examination conducted or approved by the Board, and he has:
(i) within the period of 12 months immediately before the date of his application, been the holder of a licence or certificate specified in Schedule 2 and it was granted based upon an examination or practical experience and training of the applicant and that experience and training is, in the opinion of the Board, at least equivalent to the experience and training which an electrical fitter apprentice would obtain during his apprenticeship in the Territory; or
(ii) completed an apprenticeship to the trade of electrical fitter or electrical fitter/ mechanic and satisfactorily completed a course of instruction for electrical fitter apprentices, outside the Territory but in a State, other Territory or New Zealand, which does not licence electrical fitters.
The qualifications required for the granting of an application for an electrical worker's licence endorsed as electrical linesman grade A are that the applicant:
(a) was, immediately before the commencement of the Electrical Workers and Contractors Amendment Act 1983, the holder of an electrical mechanic's licence grade R endorsed as a linesman without restriction, under the Electrical Workers and Contractors Act 1978 as then in force;
(b) has:
(i) completed an apprenticeship to the trade of electrical linesman/X.P.L.E. cable jointing under the Training and Skills Development Act 2016; and
(ii) satisfactorily completed the course of instruction for electrical linesman/ X.P.L.E. cable jointing apprentices at a College;
(c) has, in the opinion of the Board, sufficient knowledge of the trade of electrical linesman, evidenced, where the Board thinks fit, by an examination conducted or approved of by the Board, and he:
(i) holds an electrical worker's licence endorsed as electrical mechanic or electrical fitter, has at least 3 months experience working on overhead electrical line construction or maintenance and produces a certificate from an electrical engineer or the holder of an electrical worker's licence endorsed as electrical linesman grade A stating that the applicant has had at least 300 hours experience working up a pole on dead line work and that, in the opinion of the engineer or holder, the applicant is suitable for this class of work; or
(ii) has completed an apprenticeship to the trade of electrical linesman but has failed to complete satisfactorily the course of instruction for electrical linesman/ X.P.L.E. cable jointing apprentices at a College; or
(d) has, in the opinion of the Board, sufficient knowledge of the trade of electrical linesman evidenced, where the Board thinks fit, by an examination conducted or approved by the Board, and he:
(i) has been employed outside the Territory as an electrical linesman for at least 2 years; and
(ii) produces a certificate from his employer for the period stating that the applicant's conduct has been satisfactory and outlining the experience the applicant has had in the construction and maintenance of overhead electrical lines and the previous employment and experience is, in the opinion of the Board, at least equivalent to the experience and training which an electrical linesman/X.P.L.E. cable jointer apprentice would obtain during his apprenticeship in the Territory.
The qualifications required for the granting of an application for an electrical worker's licence endorsed as an electrical cable jointer grade A are that the applicant:
(a) was immediately before the commencement of the Electrical Workers and Contractors Amendment Act 1983, the holder of an electrical mechanic's licence grade R endorsed as a cable jointer without restriction, under the Electrical Workers and Contractors Act 1978 as then in force;
(b) has, in the opinion of the Board, sufficient knowledge of the trade of electrical cable jointer evidenced, where the Board thinks fit, by an examination conducted or approved by the Board and he:
(i) has been employed as an assistant in electrical cable jointing work for at least 2 years, has satisfactorily completed a theoretical and practical training course, satisfactory to the Board, in relation to electrical cable jointing, produces a certificate from his employer for the period stating that the applicant's conduct has been satisfactory and outlining the experience he has had in the electrical industry and produces a certificate from an electrical engineer or the holder of an electrical worker's licence endorsed as electrical cable jointer grade A stating that the applicant has at least 300 hours experience in jointing and terminating cables that are not energized and that, in the opinion of the engineer or holder, the applicant is suitable for this class of work;
(ii) is the holder of an electrical worker's licence endorsed as electrical mechanic or electrical fitter, produces evidence of at least 3 months experience in the work of an electrical cable jointer and produces a certificate from an electrical engineer or the holder of an electrical worker's licence endorsed as electrical cable jointer grade A stating that the applicant has at least 300 hours experience in jointing and terminating cables that are not energized and that, in the opinion of the engineer or holder, the applicant is suitable for this class of work; or
(iii) has been employed outside the Territory as an electrical cable jointer for at least 2 years and produces a certificate from his employer for that period stating that his conduct has been satisfactory and outlining the experience he has had in the work of an electrical cable jointer and the certificate and experience outlined in it are satisfactory to the Board.
(1) The qualifications required for the granting of an application for an electrical worker's licence endorsed as electrical mechanic grade B are that the applicant:
(a) was, immediately before the commencement of the Electrical Workers and Contractors Amendment Act 1983, the holder of a "B" grade licence endorsed as an electrical mechanic under the Electrical Workers and Contractors Act 1978 as then in force;
(b) has, in the opinion of the Board, sufficient knowledge of the trade of electrical mechanic evidenced, where the Board thinks fit, by an examination conducted or approved by the Board and has:
(i) within the Territory:
(A) completed an apprenticeship to the trade of electrical fitter/mechanic under the Training and Skills Development Act 2016; and
(B) during his apprenticeship, obtained at least 12 months experience in the trade work of an electrical mechanic,
but has failed to satisfactorily complete the course of instruction for electrical fitter/mechanic apprentices at a College;
(ii) outside the Territory:
(A) completed an apprenticeship to the trade of electrical mechanic or electrical fitter/mechanic; and
(B) during his apprenticeship obtained at least 12 months experience in the trade work of an electrical mechanic,
but has failed to satisfactorily complete a course of instruction for electrical mechanic or electrical fitter/mechanic apprentices; or
(iii) within the period of 12 months immediately before the date of his application, been the holder of a licence from a State, Territory or New Zealand to carry out work equivalent to the work the holder of an electrical worker's licence endorsed as electrical mechanic grade B is permitted to carry out and the licence was granted based upon an examination or practical experience and training of the applicant and that experience and training is, in the opinion of the Board, equivalent to the experience and training which an apprentice electrical fitter/mechanic would obtain during his apprenticeship in the Territory.
The qualifications required for the granting of an application for an electrical worker's licence endorsed as electrical fitter grade B are that the applicant has, in the opinion of the Board, sufficient knowledge of the trade of electrical fitter or electrical fitter/mechanic evidenced, where the Board thinks fit, by an examination conducted or approved by the Board and he has:
(a) within the Territory:
(i) completed an apprenticeship to the trade of electrical fitter or electrical fitter/mechanic under the Training and Skills Development Act 2016; and
(ii) during his apprenticeship, obtained at least 12 months experience in the trade work of an electrical fitter,
but has failed to satisfactorily complete the course of instruction for electrical fitter or electrical fitter/mechanic apprentices at a College;
(b) outside the Territory:
(i) completed an apprenticeship to the trade of electrical fitter or electrical fitter/ mechanic; and
(ii) during his apprenticeship, obtained at least 12 months experience in the trade work of an electrical fitter,
but has failed to satisfactorily complete a course of instruction for electrical fitter or electrical fitter/mechanic apprentices; or
(c) within the period of 12 months immediately before the date of his application, been the holder of a licence from a State, Territory or New Zealand to carry out work equivalent to the work the holder of an electrical worker's licence endorsed as electrical fitter grade B is permitted to carry out and the licence was granted based upon an examination or practical experience and training of the applicant and that experience and training is, in the opinion of the Board, at least equivalent to the experience and training which an electrical fitter apprentice would obtain during his apprenticeship in the Territory.
(1) For the purposes of section 18(1)(e) of the Act, refrigeration mechanic is a prescribed trade classification.
(2) The qualifications required for the granting of an application for an electrical worker's licence endorsed as refrigeration mechanic grade R are that the applicant:
(a) was, immediately before the commencement of the Electrical Workers and Contractors Amendment Act 1983, the holder of an electrical mechanics licence grade R endorsed as a refrigeration mechanic, under the Electrical Workers and Contractors Act 1978 as then in force; or
(b) has, in the opinion of the Board, sufficient knowledge of the trade of refrigeration mechanic evidenced, where the Board thinks fit, by an examination conducted or approved by the Board and:
(i) within the Territory, he has completed an apprenticeship to the trade of refrigeration mechanic under the Training and Skills Development Act 2016;
(ii) outside the Territory, he has completed an apprenticeship to the trade of refrigeration mechanic;
(iii) he is the holder of a tradesman's certificate in a classification which, in the opinion of the Board, is appropriate;
(iv) within the period of 12 months immediately before the date of his application, he has been the holder of a licence from a State, Territory or New Zealand to carry out work at least equivalent to the work the holder of an electrical worker's licence endorsed as refrigeration mechanic grade R is permitted to carry out; or
(v) he has completed an apprenticeship to another trade classification and subsequently:
(A) obtained experience in the trade of refrigeration mechanic; and
(B) satisfactorily completed a course of instruction in relation to refrigeration mechanics,
and that experience and course is, in the opinion of the Board, at least equivalent to the experience and course which a refrigeration mechanic apprentice would obtain or complete, as the case may be, during his apprenticeship in the Territory.
(1) For the purposes of section 18(1)(e) of the Act, instrument fitter is a prescribed trade classification.
(2) The qualifications required for the granting of an application for an electrical worker's licence endorsed as instrument fitter grade R are that he:
(a) was, immediately before the commencement of the Electrical Workers and Contractors Amendment Act 1983, the holder of an electrical mechanic's licence grade R endorsed as instrument fitter, under the Electrical Workers and Contractors Act 1978 as then in force; or
(b) has, in the opinion of the Board, sufficient knowledge of the trade of instrument fitter evidenced, where the Board thinks fit, by an examination conducted or approved by the Board and:
(i) within the Territory, he has completed an apprenticeship to the trade of instrument fitter under the Training and Skills Development Act 2016;
(ii) outside the Territory, he has completed an apprenticeship to the trade of instrument fitter;
(iii) he is the holder of a tradesman's certifi-cate in a classification which, in the opinion of the Board, is appropriate;
(iv) within the period of 12 months immediately before the date of his application, he has been the holder of a licence from a State, Territory or New Zealand to carry out work equivalent to the work the holder of an electrical worker's licence endorsed as instrument fitter grade R is permitted to carry out; or
(v) he has completed an apprenticeship to another trade classification and subsequently:
(A) obtained experience in the trade of instrument fitting; and
(B) satisfactorily completed a course of instruction in relation to instrument fitting,
and that experience and course is, in the opinion of the Board, at least equivalent to the experience and course which an instrument fitter apprentice would obtain or complete, as the case may be, during his apprenticeship in the Territory.
For :
(a) section 21(1)(f) of the Act, the prescribed fee is:
(i) 217 revenue units; or
(ii) where the applicant is already the holder of an electrical worker's licence, 43 revenue units; and
(b) section 21(1A) of the Act, an application under section 21(1) for an electrical worker's licence shall be in accordance with Form 1.
For the purposes of section 24(1)(a) of the Act, an electrical worker's licence shall be in accordance with Form 2.
(1) It is a condition of every licence that, subject to subsection (2), the licence entitles the holder to carry out electrical work in the trade classification for which it is endorsed subject to conditions specified in the licence.
(2) An electrical worker's licence does not entitle the holder to carry out electrical work unless it is carried out:
(a) otherwise than for a fee or reward;
(b) for the purpose of wiring his own or his employer's premises or capital equipment; or
(c) as an employee of the holder of an electrical contractor's licence.
For section 25 of the Act:
(a) an application for renewal of an electrical worker's licence must be in accordance with Form 3; and
(b) the prescribed fee is 217 revenue units.
Part
III Electrical contractors' licences
For the purposes of section 33(1) of the Act, an application by a natural person for an electrical contractor's licence shall be in accordance with Form 4.
For the purposes of section 33(2) of the Act, an application by an incorporated or unincorporated body or other association of persons for an electrical contractor's licence shall be in accordance with Form 5.
For section 34(1)(b) of the Act, the prescribed fee for an application by a natural person for an electrical contractor's licence is the following:
(a) for a one year licence – 347 revenue units;
(b) for a 2 year licence – 608 revenue units;
(c) for a 3 year licence – 782 revenue units;
(d) where the applicant is already the holder of an electrical contractor's licence – 43 revenue units
For the purposes of section 34(2)(e) of the Act, the prescribed fee for an application by an incorporated or unincorporated body or other association of persons for an electrical contractor's licence is the following:
(a) for a one year licence – 347 revenue units;
(b) for a 2 year licence – 608 revenue units;
(c) for a 3 year licence – 782 revenue units;
(d) where the applicant is already the holder of an electrical contractor's licence – 43 revenue units.
For the purposes of section 37(1)(a) of the Act, an electrical contractor's licence shall be in accordance with Form 6.
For section 38 of the Act:
(a) an application for renewal of an electrical con-tractor's licence must be in accordance with Form 7; and
(b) the prescribed fee is the following:
(i) for a one year licence – 347 revenue units;
(ii) for a 2 year licence – 608 revenue units;
(iii) for a 3 year licence – 782 revenue units..
For the purposes of section 42B(1)(b) of the Act, a prescribed examination is an examination which is conducted by a College at the completion of the second year of an apprentice's course and covers the theoretical and practical subjects which are part of the apprentice's course up to that date.
For section 52 of the Act, the pre-scribed fee for the issue of a copy of:
(a) an electrical worker's licence is 43 revenue units and;
(b) a permit is 43 revenue units; and
(c) an electrical contractor's licence is 43 revenue units.
For the purposes of section 53(g) of the Act, a prescribed body includes a College.
Certificate of competency endorsed as an electrical mechanic, issued under the Electricity Act 1976 of Queensland and Regulations under that Act.
A Grade Electrical Worker's Licence, or an unrestricted "B" Grade Electrical Worker's Licence endorsed for installing, issued under the Electricity Act, 1945 of Western Australia and Regulations under that Act.
Electrician's licence issued under the Electricity Development Act, 1945 of New South Wales and Regulations under that Act.
A Grade electrical mechanic's licence issued under the State Electricity Commission Act 1958 of Victoria and Regulations under that Act.
A grade electrical mechanic's licence issued under the Hydro-Electric Commission Act 1944 of Tasmania and Regulations under that Act.
A Class Electrical Worker's Licence issued under the Electrical Workers and Contractors Licensing Act, 1965-1978 of South Australia and Regulations under that Act.
Electrician's licence, Grade A issued under the Electricity Ordinance 1972 of the Australian Capital Territory and Regulations under that Act.
Certificate of Registration as an electrical technician or "electrician", issued under the Electrical Registration Act 1979 of New Zealand and Regulations under that Act.
Certificate of competency endorsed as an electrical fitter, issued under the Electricity Act 1976 of Queensland and Regulations under that Act.
A Grade Electrical Worker's Licence, or an unrestricted "B" Grade Electrical Worker's Licence endorsed for Fitting, issued under the Electricity Act, 1945 of Western Australia and Regulations under that Act.
A Class Electrical Worker's Licence issued under the Electrical Workers and Contractors Licensing Act, 1965-1978 of South Australia and Regulations under that Act.
