CONSUMER AFFAIRS (PRODUCT SAFETY STANDARDS) REGULATIONS

Regulations under the Consumer Affairs and Fair Trading Act

  1. Citation

These Regulations may be cited as the Consumer Affairs (Product Safety Standards) Regulations.

  1. Product safety standard for baby-walkers

(1) In this regulation:

baby-walker means a device that:

(a) consists of a frame on wheels designed to support, inside the frame and with the child's feet touching the ground, a child who has not yet learned to walk; and

(b) is propelled by the movement of the child.

(2) Section 6.1, 6.4 and 9.3 of the American Society for Testing and Materials Consumer Safety Specification for Infant Walkers, published in July 2000 and available on the internet at www.astm.org, is a product safety standard for baby-walkers.

  1. Product safety standard for domestic bunk beds

(1) In this regulation:

domestic bunk bed means:

(a) a set of components that are assembled or are ready for assembly into single beds or double/single combination beds which will be stacked one over the other; or

(b) a single bed, other than a hospital bed, where the upper surface of the mattress base is at least 800 mm above the floor surface,

but does not include a bunk bed used in a caravan or an accommodation establishment within the meaning of the Accommodation Providers Act.

(2) The Australian/New Zealand Standard AS/NZS 4220:1994, Bunk beds, as applied by subregulation (3), is a product safety standard for domestic bunk beds.

(3) For the purposes of subregulation (2), Australian New Zealand Standard AS/NZS 4220:1994, Bunk beds applies and has force as a product safety standard for domestic bunk beds as if:

(a) clauses 1, 2, 4, 5, 6.1, 6.2, 6.5, 6.6, 6.7, 6.9, 7.1(c), 7.2, 7.3, 7.4, 7.5, 7.6, 7.7, 7.8, 7.9, 7.10, 8, 9(b)(i) and 9(d) of the Standard were omitted;

(b) the text in clause 3.1 of the Standard were omitted and the following substituted in its place:

"Bunk Bed:

(a) A set of components that are assembled or are ready for assembly into single beds or double/single combination beds which will be stacked one over the other; or

(b) Any single bed, other than a hospital bed, where the upper surface of the mattress base is at least 800 mm above the floor surface.";

(c) "75 mm" were omitted from clause 7.1(b) of the Standard and "95 mm" substituted in its place;

(d) the following words were inserted at the beginning of clause 9(c) of the Standard:

For the upper bed, where the height of the guard rails is less than 360 mm above the mattress base:;

(e) "75±0.5 mm" were omitted from Appendix A, part A3(a)(iv) to the Standard and "95±0.5 mm" substituted in its place;

(f) Appendix A, part A3(b) to the Standard were omitted;

(g) "Place a mattress on each of the mattress bases of the bunk bed." were omitted from Appendix A, part A5(a) to the Standard;

(h) "75 mm" were omitted from Appendix A, parts A5(e) and A6(c) to the Standard and "95 mm" substituted in its place; and

(i) Appendices B, C, D, E, F, G, H, I and J to the Standard were omitted.
