Import Processing Charges Regulations 2001
Section 8 of the Import Processing Charges Act 1997 (the Charges Act) provides that the Governor-General may make regulations for the purposes of sections 5, 6 and 7 of that Act.
The Charges Act imposes a number of charges that are payable under the Customs Act 1901 for the processing of Customs import entries and the screening of cargo reports. These include the entry processing charge and the screening charge.
Sections 6 and 7 of the Charges Act set out the amounts of those charges as well as allowing other amounts to be prescribed. However, the Charges Act sets upper limits for the amounts that can be prescribed.
The purpose of the new Regulations is to increase certain entry processing charges and screening charges. These increases are necessary due to the increased cost of processing entries and screening cargo as a result of Australia’s response to the threat of the introduction of Foot and Mouth Disease into Australia.
The new charges are as follows:
• the flat rate for type B entries and type C entries will be $27.10 up from $22.80 (subregulation 4(1) of the new Regulations refers);
• the flat rate for type E entries and type F entries will be $48.85 up from $44.55 (subregulation 4(2) of the new Regulations refers);
• the screening charge payable in respect of each line of a documentary or electronic cargo report that relates to a consignment of goods of a kind referred to in paragraph 68(1)(f) of the Customs Act 1901 will be $3.60 up from $2.40 (subregulation 5(1) of the new Regulations refers); and
• the screening charge payable in respect of cargo reports made by special reporters will be $67.50 up from $45.00 (subregulations 5(2) and (3) of the new Regulations refer).
All of these new charges are within the upper limits set out in the Charges Act.
The new Regulations commenced on 1 July 2001.
