Air Navigation Regulations (Amendment)
Subsection 26(1) of the Air Navigation Act 1920 (the Act) provides that the GovernorGeneral may make regulations for the purposes of the Act.
Australia has an international legal obligation to comply with Security Council Resolutions. This amendment to the Air Navigation Regulations is in accordance with the United Nations Security Council Resolution 948 (1994) made on 15 October 1994 welcoming the return of President Aristide to Haiti, and noting that sanctions would be lifted automatically in accordance with Security Council Resolution 944 (1994).
Specifically, Resolution 944 (1994) provides that sanctions would end at one minute past midnight on the day after President Aristide's return. Sanctions were subsequently lifted at 12.01 am on 16 October 1994.
These amendments to the Air Navigation Regulations repeal regulation 3 11 G which prohibited:
• an Australian aircraft from travelling to or from Haiti without the Secretary's written permission; and
• an aircraft which leaves Haiti or which is destined to land in Haiti, from landing in, being flown over or being flown from, Australian territory without the Secretary's written permission.
These Regulations implement Resolution 944 (1994) for the purposes of the Air Navigation Regulations.
