The National Code of Practice for Control of Workplace
Hazardous Substances [NOHSC:2007 (1994)] lists, in priority order, the
hierarchy of control measures for use in carrying out risk control. Guidance
on exposure standards can be found in the Exposure Standards for Atmospheric
Contaminants in the Occupational Environment [NOHSC:1003 (1995)].
- (1)
- An
operator must ensure that no employee or contractor at work is exposed to an
airborne concentration (measured over the length of time relevant to an
exposure standard) of a hazardous substance, in the breathing zone of the
employee or contractor, at a level that exceeds the exposure standard.
Penalty:
10 penalty units.
(2) An operator must ensure, on the basis of a
risk assessment carried out under regulation 2.15, that exposure to a
hazardous substance is:
- (a)
- prevented; or
(b) if it is not reasonably practicable to prevent the exposure
adequately controlled in order to minimise the risks to health caused by the
substance.
Penalty:
10 penalty units.
- (3)
- An operator must take all
reasonably practicable steps to prevent or control exposure to a
hazardous substance by measures other than the provision of personal
protective equipment.
Penalty:
10 penalty units.
- (4)
- If measures
undertaken in accordance with subregulation (3) do not prevent, or provide
adequate control of, exposure of an employee or a contractor to a
hazardous substance, the operator must, in addition to taking the measures,
make available to the employee or contractor suitable personal protective
equipment that will adequately control the employee's or contractor's exposure
to the hazardous substance.
Penalty:
10 penalty units.

- An operator
must ensure that engineering controls, safe work practices and personal
protective equipment that are used to prevent or control exposure to a
hazardous substance are properly maintained and used.
Penalty:
10 penalty
units.
