CORPORATIONS REGULATIONS (AMENDMENT) 1998 No. 185 - REG 16

16. Part 2.3 (Legal capacity, powers and status)
16.1 Part heading: Omit the heading, substitute:

"PART 2B.6-NAMES Availability of names (Corporations Law, s 147)

"2B.6.01 (1) For paragraphs 147 (1) (a) and (b) of the Corporations Law, the
rules for ascertaining whether a name is identical with another name are the
rules set out in Part 1 of Schedule 6.

"(2) For paragraph 147 (1) (c) of the Corporations Law, a name is unacceptable
for registration under the regulations if it is unacceptable under the rules
set out in Part 2 of Schedule 6. Ministerial consent required for use of
certain expressions in names

"2B.6.02 If:

   (a)  an application is made under one of the following sections of the
        Corporations Law:

        (i)    in the case of registration of a name-section 117;

        (ii)   in the case of reservation of a name-section 152;

        (iii)  in the case of change of a name-section 157; and

   (b)  the name contains a word or phrase specified in column 2 of Part 4 of
        Schedule 6; the application must be accompanied by the consent in
        writing of the Minister specified in column 3 in relation to that
        name. Exemptions from requirement to set out name and ACN on certain
        documents (Corporations Law, s 155)

"2B.6.03 For section 155 of the Corporations Law, the exemptions provided for
in Schedule 7 apply in relation to the requirements of subsection 153 (2) of
the Law.".
