                 SUPPLEMENTARY EXPLANATORY MEMORANDUM

                   Amendments to be moved on behalf of the Government

The Telecommunications (Regional Broadband Scheme) Charge Bill 2019 (the Charge Bill)
operates in tandem with Schedule 4 to the Telecommunications Legislation Amendment
(Competition and Consumer) Bill 2019 (TLA (CC) Bill). Schedule 4 to the TLA (CC) Bill,
among other things, sets out key definitions associated with the charge base of the Regional
Charge Bill, and these definitions would be inserted into Part 3 of the Telecommunications
(Consumer Protection and Service Standards) Act 1999. Several of those terms are also used
and defined in clause 3 of the Charge Bill, including the term, 'fixed wireless broadband
service'.

As introduced into the Senate, the Charge Bill erroneously defines 'fixed wireless broadband
service' as having the same meaning as in the Telecommunications Act 1997. Amendment
Sheet QL146 would correct this error and provide that such a term has the same meaning as
in Part 3 of the Telecommunications (Consumer Protection and Service Standards) Act 1999.

Amendment (1)

Amendment (1) makes a technical correction to the definition of 'fixed wireless broadband
service' in clause 3 of the Charge Bill, by replacing it with the corrected definition. This
amendment does not change the policy intent or operation of the Regional Broadband
Scheme.
