                            EXPLANATORY MEMORANDUM




Clause 3 - Schedules

Item 5 and 6 - Section 116AB and proposed section 116ABA


Page 7, fifth line--insert 'It is intended that where a service provider engages a third party to
carry out such activities on its behalf, that service provider will also be covered by the safe
harbour scheme.', after 'that provider will be covered by the safe harbour scheme.'.


This addendum responds to concerns raised by the Senate Environment and Communications
Legislation Committee in its report on the Copyright Amendment (Service Providers) Bill
2017 dated 19 March 2018.
