OUTLINE
The purpose of the Bill is to increase the size of
the Board of the Civil Aviation Safety Authority (CASA) by the addition of a
Deputy Chairperson and an additional ordinary member.
FINANCIAL IMPACT STATEMENT
The financial impact resulting from the remuneration
of a part-time Deputy Chairperson and a part-time ordinary Board member would be
approximately $47,000 per annum.
NOTES ON CLAUSES
Clause 1 - Short
title
The Bill, when enacted,
will be known as the Civil Aviation Amendment Act
1996.
Clause 2 -
Commencement
The Bill will
commence on the day on which it receives the Royal
Assent.
Clause 3

This clause
provides for the Civil Aviation Act 1988 (the Act) to be amended as set
out in Schedule 1.
SCHEDULE 1 - AMENDMENT OF
THE CIVIL AVIATION ACT 1988

This item amends
subsection 3(1) of the Act by inserting a new definition of “Deputy
Chairperson”.

This item amends the
definition of “member” in subsection 3(1) of the Act to include the
Deputy Chairperson.

This item inserts a new
paragraph 33(1)(aa) into the Act. The effect of this amendment is to establish
the position of Deputy Chairperson as a member of the Board of
CASA.

This item amends paragraph
33(1)(c) of the Act to increase from 3 to 4 the maximum number of ordinary
members which may be appointed to the Board of
CASA.

This item amends
subsection 38(1) of the Act to provide that the Minister may appoint the Deputy
Chairperson or another member to act as the
Chairperson.

This item inserts a new
subsection 38(2) into the Act which deals with the appointment of an acting
Deputy Chairperson.

This item amends paragraph
38(3)(b) of the Act to enable the Minister to appoint a person to act as an
ordinary member during any period, or during all periods, when an ordinary
member is acting as the Deputy
Chairperson.

This item substitutes a
new paragraph 39(2)(b) which requires the Chairperson to convene a meeting if he
or she receives a written request signed by at least 2
members.

This item inserts a new
subsection 39(4A) which provides that if the Chairperson is not present at a
meeting, the Deputy Chairperson must
preside.

This item amends
subsection 39(5) to provide that where neither the Chairperson nor Deputy
Chairperson are present at a meeting, the members present must appoint one of
their number to preside.

This item substitutes a
new subsection 39(6) which provides that a quorum consists of the majority of
the members for the time being holding office.
