AUSTRALIAN RADIATION PROTECTION AND NUCLEAR SAFETY (LICENCE CHARGES) BILL 1998
OUTLINE
The purpose of this Bill is to enable annual charges to be levied in
respect of licences issued under the Australian Radiation Protection and
Nuclear Safety Act 1998.
FINANCIAL IMPACT STATEMENT
This Act will not have any significant financial impact for the
Commonwealth. There will be notional transfers of monies between Commonwealth
Departments.

NOTES ON CLAUSES
PART 1 - PRELIMINARY
Clause 1 - Short
title
This is a formal provision that specifies the short title of
the Act as the Australian Radiation Protection and Nuclear Safety (Licence
Charges) Act 1998.
Clause 2 - Commencement
This clause
provides that the Act will commence on the same day as the Australian
Radiation Protection and Nuclear Safety Act 1998 commences.
Clause
3 - Definitions
This clause sets out the definitions for
“facility licence” and “source licence”, which refer to
licences issued under the Australian Radiation Protection and Nuclear Safety
Act 1998.
Clause 4 - Facility licence - annual
charge
Subclause 4(1) provides that any person who is a holder
of a facility licence at any time during a financial year is liable for a charge
for the licence for that year.
Subclause 4(2) provides that the
amount of the charge for a year is to be the amount prescribed in the
regulations.
Clause 5 - Source licence - annual
charge
Subclause 5(1) provides that any person who is a holder
of a source licence at any time during a financial year is liable for a charge
for the licence for that year.
Subclause 5(2) provides that the
amount of the charge for a year is to be the amount prescribed in the
regulations.
Clause 6 - Regulations
This clause enables the
Governor-General to make regulations prescribing matters required or permitted
to be prescribed, or necessary or convenient to be prescribed for carrying out
or giving effect to this Act.
