1 Short title

This Act is the
Remuneration Tribunal Amendment (There For

Public Service, Not Profit) Act 2025
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

1 After subsection 7(3)

Insert:

(3AAA) An amount of remuneration determined under subsection (3) to be
6
paid to the holder of a public office for a year must be less than:
7
(a) $430,000, unless paragraph (b) applies; or
8
(b) if the Minister prescribes an amount for the year under
9
subsection 7A(1)--that amount.

2 Subsection 7(3F)

Repeal the subsection, substitute:

(3F) In determining under subsection (3D) the terms and conditions as
13
to the remuneration or band of remuneration that is to be applicable
14
to a classification within a classification structure, the Tribunal
15
must:
16
(a) have regard to the superannuation entitlements of the holders
17
of principal executive offices assigned to the classification;
18
and
19
(b) determine an amount of remuneration, or maximum amount
20
in a band of remuneration, for a year that is less than:
21
(i) $430,000, unless subparagraph (ii) applies; or
22
(ii) if the Minister prescribes an amount for the year under
23
subsection 7A(1)--that amount.

7A Minister may prescribe remuneration amount

(1) The Minister may, by legislative instrument, prescribe an amount
28
for a year for the purposes of paragraph 7(3AAA)(b) and
29
subparagraph 7(3F)(b)(ii).

(2) An instrument made under subsection (1) that prescribes an

amount for a year is of no effect in relation to that year unless the
2
instrument is made on or before 1 July
in the preceding year.

Omit "Except with the written consent of the Tribunal, an", substitute

"An".

5 At the end of section 13

Add:

(6) A classification structure, or any matter, determined under this
9
section must not set an amount of remuneration for a year for a
10
classification that is more than:

(a) $430,000, unless paragraph (b) applies; or
12
(b) if the Minister prescribes an amount for the year under
13
subsection (7)--that amount.

(7) The Minister may, by legislative instrument, prescribe an amount
15
for a year for the purposes of paragraph (6)(b).

(8) An instrument made under subsection (7) that prescribes an
17
amount for a year is of no effect in relation to that year unless the
18
instrument is made on or before 1 July
in the preceding year.

6 Application

The amendments of the
Remuneration Tribunal Act 1973
made by this
21
Schedule apply to determinations made under that Act on or after the
22
commencement of this item.
