Act 1902, and for related purposes

The Parliament of Australia enacts:

1 Short title
4
This Act may be cited as the Royal Commissions Amendment Act
5
2013.

2 Commencement
7
This Act commences on the day this Act receives the Royal
8
Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule

members (except if paragraph (a) applies)--the members of

the Commission, or a quorum of those members;

(c) in relation to a sole Commissioner--the Commissioner.

Commission if each of the members holding the hearing is either:

(a) the President or Chair of the Commission; or

(b) authorised in writing by the President or Chair of the

Commission to hold authorised member hearings in relation
18
to the Commission.

(1B) The following person presides at an authorised member hearing:
20
(a) the President or Chair of the Commission;
21
(b) if the President or Chair is not one of the members holding an
22
authorised member hearing--the member of the Commission
23
who is authorised in writing by the President or Chair to
24
preside at the hearing.

6OA Definitions
26
In this Part:
27
Child Sexual Abuse Royal Commission means the Royal
28
Commission into Institutional Responses to Child Sexual Abuse

issued by the Governor-General by Letters Patent on 11 January
1
2013 (and including any later variations of those Letters Patent).

private session means a private session held under section 6OB.

6OB Power to hold private sessions
4
(1) Any of the following members of the Child Sexual Abuse Royal
5
Commission may hold a private session to obtain information in
6
relation to matters into which the Commission is inquiring:
7
(a) the Chair of the Commission;
8
(b) a member who is authorised in writing by the Chair of the
9
Commission.
10
(2) A private session may be held only by one or 2 members referred
11
to in subsection (1).
12
(3) Any member of the Commission holding a private session may
13
(subject to the Letters Patent establishing the Commission and
14
section 6OD) determine any matters relating to the conduct of the
15
private session, having regard to any directions given by the Chair
16
of the Commission.

6OC Status of private session
18
(1) A person who appears at a private session:
19
(a) is not a witness before the Commission; and
20
(b) does not give evidence to the Commission.
21
(2) A private session is not a hearing of the Commission.
22
Powers of Commission and custody and use of records
23
(3) The following provisions apply as if information, a document,
24
record or other thing obtained by one or 2 members of the Child
25
Sexual Abuse Royal Commission at a private session were
26
produced before, delivered or given to, or otherwise obtained or
27
received by, the Commission:
28
(a) section 6F (power of Commission in relation to documents
29
and other things);
30
(b) section 6P (Commission may communicate information);
31
(c) section 9 (custody and use of records of Royal Commission).

(4) Section 9 (custody and use of records of Royal Commission) also
1
applies as if a record produced by one or 2 members of the Child
2
Sexual Abuse Royal Commission at a private session were
3
produced by the Commission.

Application of Part 4 (offences)
5
(5) Sections 6H (false or misleading evidence), 6I (bribery of witness),
6
6J (fraud on witness), 6L (preventing witness from attending), 6M
7
(injury to witness) and 6N (dismissal by employers of witness)
8
apply as if:
9
(a) a person who appears, or intends to appear, at a private
10
session were called or summoned, or appeared, as a witness
11
before the Child Sexual Abuse Royal Commission; and
12
(b) any information provided, or that a person intends to provide,
13
at a private session were testimony or evidence given at a
14
hearing before the Commission; and
15
(c) any document or other thing that a person produces, or
16
intends to produce, at a private session was produced or
17
would have been produced because the person was required
18
to do so under a summons, requirement or notice under
19
section 2.
20
(6) Section 6O (contempt of Royal Commission) applies in relation to
21
a private session as if:
22
(a) the member or members of the Child Sexual Abuse Royal
23
Commission holding the private session were the
24
Commission; and
25
(b) the private session were proceedings of the Commission.

6OD Privacy of private sessions
27
(1) A private session must be held in private, and only persons who are
28
authorised by a member of the Child Sexual Abuse Royal
29
Commission holding the private session may be present during the
30
private session.
31
Offence for using or disclosing information obtained at a private
32
session
33
(2) A person commits an offence if:
34
(a) the person obtains information at a private session; and

(b) the person uses or discloses the information; and
1
(c) neither of the following applies:
2
(i) the use or disclosure is for the purposes of performing
3
functions or duties or exercising powers in relation to
4
the Child Sexual Abuse Royal Commission;
5
(ii) the person is authorised to use, disclose or publish the
6
information under subsection (3) or section 6P
7
(Commission may communicate information) or 9
8
(custody and use of records of Commission).

Penalty: 20 penalty units or 12 months imprisonment or both.
10
Inclusion of information in reports and recommendations
11
(3) Information that relates to a natural person that has been obtained
12
at a private session may be included in a report or recommendation
13
of the Child Sexual Abuse Royal Commission only if:
14
(a) the information is also given as evidence to the Commission
15
or under a summons, requirement or notice under section 2;
16
or
17
(b) the information is de-identified.

Archives Act 1983
19
(4) The Archives Act 1983 applies in relation to information obtained
20
at a private session as if a direction had been given by the Child
21
Sexual Abuse Royal Commission prohibiting the publication of the
22
information.

6OE Statements made and documents produced etc. at a private
24
session are not admissible in evidence
25
(1) The following are not admissible in evidence against a natural
26
person in any civil or criminal proceedings in any court of the
27
Commonwealth, of a State or of a Territory:
28
(a) a statement or disclosure made by the person at a private
29
session;
30
(b) the production of a document or other thing by the person at
31
a private session.
32
(2) Subsection (1) does not apply to the admissibility of evidence in
33
proceedings for an offence against this Act.

6OF Protection of those who appear, or are authorised to be

present, at a private session
2
(1) Any person who appears, or is authorised to be present, at a private
3
session has the same protection and, in addition to the penalties
4
provided by this Act, is to be subject to the same liabilities in any
5
civil or criminal proceeding, as a witness in any case tried in the
6
High Court.
7
(2) A legal practitioner who appears on behalf of a person at a private
8
session has the same protection and immunity as a barrister has in
9
appearing for a party in proceedings in the High Court.
