The Parliament of Australia enacts:

1 Short title

This Act may be cited as the Migration Legislation Amendment
26
(Temporary Protection Visas Repeal) Act 2006.

2 Commence ment

This Act commences on the day on which it receives the Royal
29
Assent.

Each Act that is specified in a Schedule to this Act is amended or

repealed as set out in the applicable items in the Schedule
3
concerned, and any other item in a Schedule to this Act has effect
4
according to its terms.

4 Transitional

(1) On the commencement of this Act, persons holding a Temporary
7
Protection visa (Class XA, Subclass 785) will be deemed to hold a
8
Protection visa (Class XA, Subclass 866).
9
(2) On the commencement of this Act, the Minister must assess the
10
applications of persons who have applied for a Temporary
11
Protection visa (Class XA, Subclass 785) as though this Act had
12
not commenced. If their application is successful, the applicant will
13
then be deemed to hold a Protection visa (Class XA, Subclass 866).
