The Parliament of Australia enacts:

1 Short title

This Act is the Migration Amendment (Repairing Medical
5
Transfers) Act 2019.

2 Commencement
7
(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

14 Application of amendments relating to removal etc.

(1)
The amendments of subsection 198(1A) and paragraph 198(1B)(a) of
3
the Migration Act 1958 made by this Schedule apply in relation to an
4
unlawful non-citizen brought to Australia under repealed section 198C
5
of that Act before, on or after the commencement of this item.
6
(2)
The amendment of paragraph 198AH(1A)(a) of the Migration Act 1958
7
made by this Schedule applies in relation to a transitory person brought
8
to Australia under repealed section 198C of that Act before, on or after
9
the commencement of this item.

15 Effect of repeal of medical transfer provisions
11
(1)
Subsection 7(2) of the Acts Interpretation Act 1901 does not apply in
12
relation to the repeal by this Schedule of a medical transfer provision.

(2)
Despite subitem (1), the repeal by this Schedule of a medical transfer
14
provision does not affect rights or liabilities arising between parties to
15
proceedings in which:
16
(a) judgment is reserved by a court as at the commencement of
17
this item; or
18
(b) judgment has been delivered by a court before the
19
commencement of this item;
20
and the judgment sets aside, or declares invalid, a decision made under
21
a medical transfer provision.

(3)
In this item:
23
medical transfer provision means any of the following provisions of the
24
Migration Act 1958:
25
(a) subsection 198B(4);
26
(b) sections 198C to 198J;
27
(c) Subdivision D of Division 8 of Part 2;
28
(d) items 1A to 1D of the table in subsection 474(4).
