1 Short title

This Act is the
Health Insurance Amendment (General

Practitioners and Quality Assurance) Act 2020
.

2 Commencement

(1) Each provision of this Act specified in column 1 of the table
8
commences, or is taken to have commenced, in accordance with
9
column 2 of the table. Any other statement in column 2 has effect
10
according to its terms.

2 Validation of declarations
2
(1)
This item applies if:
3
(a) a declaration in relation to an activity was made by the
4
Minister under section 124X of the
Health Insurance Act
5
1973
on or after 1 July 2009 and before this item
6
commences; and
7
(b) at the time the declaration was made, the activity was a
8
quality assurance activity within the meaning of
9
subsection 124W(1) of that Act, as amended by Part 1 of this
10
Schedule.

(2)
The declaration is not invalid, and is taken never to have been invalid,
12
only because the activity was not a quality assurance activity within the
13
meaning of subsection 124W(1) of that Act as in force when the
14
declaration was made.

3 Compensation for acquisition of property
16
(1)
If the operation of item 2 would result in an acquisition of property
17
(within the meaning of paragraph 51(xxxi) of the Constitution) from a
18
person otherwise than on just terms (within the meaning of that
19
paragraph), the Commonwealth is liable to pay a reasonable amount of
20
compensation to the person.
21
(2)
If the Commonwealth and the person do not agree on the amount of the
22
compensation, the person may institute proceedings in a court of
23
competent jurisdiction for the recovery from the Commonwealth of
24
such reasonable amount of compensation as the court determines.
