1 Short title

This Act may be cited as the Higher Education Legislation

Amendment (2005 Measures No. 3) Act 2005.

(1) Each provision of this Act specified in column 1 of the table

commences, or is taken to have commenced, in accordance with

column 2 of the table. Any other statement in column 2 has effect

according to its terms.

19-80 Compliance assurance--provider (other than Table A

(1) The Minister may require a higher education provider (other than a
9

Table A provider) to be audited as to compliance with any one or
10
more of the following requirements:
11
(a) the
*
financial viability requirements;
12
(b) the
*
fairness requirements;
13
(c) the
*
compliance requirements;
14
(d) the
*
contribution and fee requirements.
15
(2) The audit must be conducted:
16
(a) by a body determined in writing by the Minister; and
17
(b) at such time or times, and in such manner, as the Minister
18
requires.
19
(3) The provider must:
20
(a) fully co-operate with the auditing body in the course of its
21
audit; and
22
(b) pay to the auditing body any charges payable for such an
23
audit.
24
(4) A determination made under paragraph (2)(a) is not a legislative
25
instrument.
