EXPLANATORY STATEMENT

Overview of the Bill

The purpose of this bill is to amend the Canberra Institute of Technology Act 1987 to revise the membership of the CIT Advisory Council.

Details of the Bill


Clause 1 Provides the name of the Act as the Canberra Institute of Technology Amendment Act 2007.

Clause 2 Provides for the commencement of the Act on the day after its notification day.

Clause 3 Provides that this Act amends the Canberra Institute of Technology Act 1987.

Clause 4 Amends the membership of the Council to (a) 1 member who represents an organisation that represents the teaching staff; and (b) 1 member who represents the student body; and (c) 7 members who represent the interests of industry and commerce; and (d) 2 members, not representing the interests of industry or commerce, who have experience and knowledge relevant to the functions of the council; and (e) 1 member who has skills in and knowledge of vocational education and training. In deciding whether to appoint a person as a member, the Minister must have regard to the desirability of ensuring that there is a balance of skills, expertise and gender among the council members. The conditions of appointment of a member are the conditions agreed between the Minister and the member subject to any determination under the Remuneration Tribunal Act 1995.

Clause 5 Renumbers Section 32 - Ending council member appointments, to Section 33.

Clause 6 Inserts a new section giving powers of review to decisions made by the Director regarding refusing admission to a course of study or examination of the institute and refusing to confer an award.

Clause 7 Renumbers Part 9 – Miscellaneous, to Part 10.

Clause 8 Renumbers Section 62 - Delegation by director, to Section 64.

Clause 9 Omits Sections 63 and 64.

Clause 10 Amends the definition of chair to be the chair of the council appointed under Section 32.

Clause 11 Amends the definition of deputy chair to be the deputy chair of the council appointed under section 32.

Clause 12 Inserts reviewable decision in see Section 61.

Clause 13 Omits chairperson and substitutes chair in Sections 38, 40 and 41.
