ADR IN HISTORICAL SEXUAL ABUSE CASES

Historical sexual abuse cases raise many complex legal and evidentiary issues in both criminal and tort law. In such cases, the less traditional, non-adversarial approach of mediation can offer a more transparent and collaborative alternative to litigation, which can be prolonged, costly and risks re-traumatising survivors of child sexual abuse. The next three articles, by Richard Royle, Wendy Blacker, Laoise O Connor and Kerry Hogan-Ross, examine mediation in such cases from the plaintiffs’, defendants’ and mediators’ perspectives respectively.
